En prévenant l'émergence d'oligopoles étroits par application du dispositif ex ante de contrôle des concentrations entre entreprises, la Commission européenne promeut une approche " structuraliste " de la collusion tacite, qui ne fait, en doctrine comme en pratique, l'objet d'aucune contestation. C'est à ce paradigme structuraliste que s'intéresse la présente étude. Après avoir décrit la genèse de la question du contrôle de la collusion tacite en théorie économique et en droit communautaire de la concurrence, l'auteur soutient que le système de contrôle des concentrations n'apporte pas une réponse juridique satisfaisante aux risques de collusion tacite sur les marchés oligopolistiques. L'étude examine alors si les règles " comportementales " du Traité de Rome (les articles 81 et 82 TCE) peuvent être sollicitées pour corriger les phénomènes collusifs tacites en oligopole. Elle y trouve, en s'appuyant sur une interprétation " dynamique " de ces dispositions, des voies d'action prometteuses. En conclusion, l'étude esquisse les contours d'un système institutionnel de contrôle " comportemental " de la collusion tacite en oligopole.
