Available in PDF, EPUB and Kindle. Book excerpt: Crime, Shame and Reintegration is a contribution to general criminological theory. Its approach is as relevant to professional burglary as to episodic delinquency or white collar crime. Braithwaite argues that some societies have higher crime rates than others because of their different processes of shaming wrongdoing. Shaming can be counterproductive, making crime problems worse. But when shaming is done within a cultural context of respect for the offender, it can be an extraordinarily powerful, efficient and just form of social control. Braithwaite identifies the social conditions for such successful shaming. If his theory is right, radically different criminal justice policies are needed - a shift away from punitive social control toward greater emphasis on moralizing social control. This book will be of interest not only to criminologists and sociologists, but to those in law, public administration and politics who are concerned with social policy and social issues.

Each chapter begins with a historical review of each theoretical perspective and how its original formulation and more recent derivatives account for racial/ethnic differences. The theoretical perspectives include those based on religion, biology, social disorganization/strain, subculture, labeling, conflict, social control, colonial, and feminism. The author considers which perspectives have shown the most promise in the area of race/ethnicity and crime.

Book excerpt: No aspect of legal formalism has interested comparative jurists as much as the extent of legislative codification across legal systems. This book looks at codification from a broad, international perspective, discussing general themes as well as various legal fields. The first of two volumes on this subject begins with a general theoretical and historical view of codification, followed by a series of other horizontal inquiries. It encompasses papers focusing on several significant contemporary issues in codification, including "codification of private law in post-soviet times", "criminal law codification beyond the nation state" and "soft codification of private law". In addition, this volume consists of general reports and national reports on administrative procedure and human rights, providing a comparative analysis of codification of law. This book is developed from papers presented at the 2012 Thematic Congress of the International Academy of Comparative Law.

Available in PDF, EPUB and Kindle. Book excerpt: Life imprisonment is a complex and drastic penal sanction. It gives the State the power to curtail the liberty of offenders for the rest of their lives. In many jurisdictions life imprisonment is the ultimate sanction for the most serious crimes. It is frequently touted as an alternative to the death penalty. At the same time, life imprisonment is often imposed as a preventive measure, where the offence alone does not justify using the ultimate sanction in the penal arsenal. The complexity of life imprisonment is frequently overlooked. Often it is assumed that it is not as drastic as it sounds, as it will not be enforced for the whole life of the offender. There may also be a reluctance to subject life imprisonment to close scrutiny, lest its perceived suitability as an alternative to the death penalty be undermined. This book tackles the complexity of life imprisonment head on by describing how various forms of it are imposed and implemented in the United States of America, in England and Wales and in Germany, as well as in the emerging international system of criminal justice. From this basis it examines the justifications advanced for life imprisonment and the modifications that have resulted in individual jurisdictions in response to criticisms of its imposition and implementation. At the same time, the book develops a more general critique of life imprisonment. It evaluates it against constitutional human rights standards that have been developed in many jurisdictions to judge the acceptability of punishment generally. It concludes that some current practices in both the imposition and implementation of life imprisonment clearly are fundamentally unacceptable, but that questions remain, even about carefully implemented life sentences imposed for the most serious crimes. The jurisprudential analysis provides the basis for a major re-evaluation of life imprisonment and raises doubts about the unquestioning acceptance of this ultimate penalty.

In this work, Eterno and Das bring experts from all over the globe to explain policing in a way that only they can do. These experts are well-versed in law enforcement methods and operations in their respective countries. Nearly every part of the globe is represented in a cornucopia of nations: Australia, Brazil, China, India, Nigeria, Russia, and the United States. Many of the contributors are world renowned scholars with practical policing experience. Each chapter brings a unique viewpoint explaining the country's police from the perspective of that country's culture. The focus of the book is on transnational crime and terrorism; however, each chapter provides a basic understanding of policing in that nation. Additionally, a chapter on current legal practices throughout the world develops a global understanding of the difficulties faced by law enforcement. To combat crime and terrorism on a global scale requires an understanding of other nations: their cultures, their laws, their viewpoints. This book, written by indigenous authors, provides unique insights into the countries being examined. The wide range of countries combined with native experts make this book a necessary first step toward properly handling international crime and terrorism.
