Book excerpt: “Victim of history,” “a martyr from behind the Iron Curtain,” “the Hungarian Gandhi” – these are just some of the epithets which people used to describe Cardinal Mindszenty, archbishop of Esztergom, who was the last Hungarian prelate to use the title of prince primate. Today, Mindszenty has been forgotten in most countries except for Hungary, but when he died in 1975, he was known all over the world as a symbol of the struggle of the Catholic Church against communism. Cardinal Mindszenty held the post of archbishop of Esztergom from 1945 until 1974, but during this period of almost three decades he served barely four years in office. The political police arrested him on December 26, 1948, and the Budapest People’s Court subsequently sentenced him to life imprisonment. Based on the Stalinist practice of show trials, one of the accusations against Mindszenty, referring to his legitimist leanings, was his alleged attempt to re-establish Habsburg rule in Hungary. He regained freedom during the 1956 revolution but only for a few days. He was granted refuge by the US Embassy in Budapest between November 4, 1956 –September 28, 1971. In the fifteen years he spent at the American embassy enormous changes took place in the world while his personality remained frozen into the past. When in 1971 Pope Paul VI received the Hungarian foreign minister, he called Mindszenty “the victim of history”. His last years were spent free at last, but far away from his homeland. In Hungary, the Catholic believers eagerly await his beatification.

Book excerpt: Undoubtedly one of the paragons of public international law in contemporary times, Colin Warbrick is truly held in high esteem by his peers at home and abroad. His breadth of knowledge is reflected in a large number of scholarly works and in his appointment as a Specialist Adviser to the Select Committee on the Constitution of the House of Lords and as a consultant to both the Council of Europe and OSCE. This "festschrift" celebrates on his retirement as Barber Professor of Jurisprudence at Birmingham University, his extraordinary talent and academic career by bringing together a group of eminent judges, practitioners and academics to write on international human rights, international criminal justice and international order and security, fields in which Professor Warbrick has left an indelible mark.

Available in PDF, EPUB and Kindle. Book excerpt: After WWII, Europe was awash in refugees. Never in modern times had so many been so destitute and displaced. No longer subjects of a single nation-state, this motley group of enemies and victims consisted of Jewish survivors of the Holocaust, ex-Soviet POWs, ex-forced laborers in the Third Reich, legions of people who fled the advancing Red Army, and many thousands uprooted by the sheer violence of the war. This book argues that postwar international relief operations went beyond their stated goal of civilian "rehabilitation" and contributed to the rise of a new internationalism, setting the terms on which future displaced persons would be treated by nations and NGOs.

Available in PDF, EPUB and Kindle. Book excerpt: A vibrant exploration of past and present controversies surrounding control of the world's oceans. In 1609, the Dutch lawyer Hugo Grotius rejected the idea that even powerful rulers could own the oceans. "A ship sailing through the sea," he wrote, "leaves behind it no more legal right than it does a track." A philosophical and legal battle ensued, but Grotius's view ultimately prevailed. To this day, "freedom of the seas" remains an important legal principle and a powerful rhetorical tool. Yet in recent decades, freedom of the seas has eroded in multiple ways and for a variety of reasons. During the world wars of the 20th century, combatants imposed unprecedented restrictions on maritime commerce, leaving international rules in tatters. National governments have steadily expanded their reach into the oceans. More recently, environmental concerns have led to new international restrictions on high seas fishing. Today's most dangerous maritime disputes-including China's push for control of the South China Sea-are occurring against the backdrop of major changes in the way the world treats the oceans. As David Bosco shows in The Poseidon Project, the history of humanity's attempt to create rules for the oceans is alive and relevant. Tracing the roots of the law of the sea and the background to current maritime disputes, he shows that building effective ocean rules while preserving maritime freedoms remains a daunting task. Bosco analyzes how fragile international institutions and determined activists are struggling for relevance in a world still dominated by national governments. As maritime tensions develop, The Poseidon Project will serve as an essential guide to the continuing challenge of ocean governance.

Available in PDF, EPUB and Kindle. Book excerpt: The development of international law is conventionally understood as a history in which the main characters (states and international lawyers) and events (wars and peace conferences) are European. Arnulf Becker Lorca demonstrates how non-Western states and lawyers appropriated nineteenth-century classical thinking in order to defend new and better rules governing non-Western states' international relations. By internalizing the standard of civilization, for example, they argued for the abrogation of unequal treaties. These appropriations contributed to the globalization of international law. With the rise of modern legal thinking and a stronger international community governed by law, peripheral lawyers seized the opportunity and used the new discourse and institutions such as the League of Nations to dissolve the standard of civilization and codify non-intervention and self-determination. These stories suggest that the history of our contemporary international legal order is not purely European; instead they suggest a history of a mestizo international law.

Book excerpt: While policy makers and scholars have long devoted considerable attention to strategies like deterrence, which threaten others with unacceptable consequences, such threat-based strategies are not always the best option. In some cases, a state may be better off seeking to give others a greater sense of security, rather than by holding their security at risk. The most prominent use of these security assurances has been in conjunction with efforts to prevent the spread of nuclear weapons. Ongoing concerns about the nuclear activities of countries like Iran and North Korea, and the possible reactions of other states in their regions, have catapulted this topic into high profile. This book represents the first study to explore the overall utility of assurance strategies, to evaluate their effectiveness as a tool for preventing nuclear proliferation, and to identify conditions under which they are more or less likely to be effective.
