Book excerpt: The OECD Review of Telecommunication Policy and Regulation in Mexico, released in 2012, provided a comprehensive examination of the sector at the time, highlighting potential areas for regulatory and policy reform. Since then, the Mexican telecommunication sector has experienced substantial progress both from a legal and regulatory perspective, but also with respect to current market dynamics. The changes derive, to an important extent, from the reform that has taken place in Mexico since 2013, which closely reflect the 2012 OECD recommendations. This report assesses subsequent market developments in the telecommunication and broadcasting sectors in Mexico, evaluates the implementation of the 2012 OECD recommendations, and puts forward a number of recommendations for the future. It records the remarkable progress made in implementing policy and regulatory changes and identifies areas where more can be done to continue the momentum that has brought tangible benefits to the people of Mexico.

Book excerpt: According to the OECD Review on Telecommunication and Broadcasting in Mexico 2017, the performance of the industry since the reforms of 2013 and 2014 has been remarkable and demonstrates what can be achieved with evidence-based policy making. In my view, the Review rather demonstrates what can be achieved by manipulating the evidence at will. It attributes to the reforms achievements that were well underway long before and closes its eyes to the many difficulties faced during their implementation. It is simply too early to arrive at an evaluation of reforms whose effects cannot be expected overnight. The Review is a good example of selling the skin before shooting the bear. By applauding the reforms the way the Review does, the OECD lost the opportunity to take albeit a bit of distance.

Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this practical guide to cyber law – the law affecting information and communication technology (ICT) – in Mexico covers every aspect of the subject, including intellectual property rights in the ICT sector, relevant competition rules, drafting and negotiating ICT-related contracts, electronic transactions, privacy issues, and computer crime. Lawyers who handle transnational matters will appreciate the detailed explanation of specific characteristics of practice and procedure. Following a general introduction, the book assembles its information and guidance in seven main areas of practice: the regulatory framework of the electronic communications market; software protection, legal protection of databases or chips, and other intellectual property matters; contracts with regard to software licensing and network services, with special attention to case law in this area; rules with regard to electronic evidence, regulation of electronic signatures, electronic banking, and electronic commerce; specific laws and regulations with respect to the liability of network operators and service providers and related product liability; protection of individual persons in the context of the processing of personal data and confidentiality; and the application of substantive criminal law in the area of ICT. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable time-saving tool for business and legal professionals alike. Lawyers representing parties with interests in Mexico will welcome this very useful guide, and academics and researchers will appreciate its value in the study of comparative law in this relatively new and challenging field.

Available in PDF, EPUB and Kindle. Book excerpt: Despite global economic disparities, recent years have seen rapid technological changes in developing countries, as it is now common to see people across all levels of society with smartphones in their hands and computers in their homes. However, does access to Information Communication Technologies (ICTs) actually improve the day-to-day lives of low-income citizens? This book argues that access to the internet can help alleviate poverty, improve development outcomes, and is now vital for realizing many human rights. This book posits that good governance is essential to the realization of inclusive pro-poor development goals, and puts forward policy recommendations that aim to mitigate the complex digital divide by employing governance as the primary actor. In making his argument, the author provides a quantitative analysis of developing countries, conjoined with a targeted in-depth study of Mexico. This mixed method approach provides an intriguing case for how improvements in the quality of governance impacts both ICT penetration, and poverty alleviation. Overall, the book challenges the neoliberal deterministic perspective that the open market will "solve" technology diffusion, and argues instead that good governance is the lynchpin that creates conducive conditions for ICTs to make an impact on poverty alleviation. In fact, the digital divide should not be considered binary, rather it is a multifaceted problem where income, education, and language all need to be considered to address it effectively. This book will be useful for researchers/students of development, communication technologies, and comparative politics as well as for development practitioners and policy makers with an interest in how modern technology is impacting the poor in the developing world.
