Book excerpt: Twenty years have passed since Mozambique emerged from civil war, in 1992. Over this period the country has successfully made the transition towards a multiparty political system and market-based economy, putting in place an increasing number of measures to stimulate the private sector and improve the business climate. Thanks in part to the reforms of the past two decades, GDP growth has averaged 7.5% since the turn of the millennium. Although foreign direct investment inflows to Mozambique increased only gradually in the early 1990s, two mega-projects - in the aluminium and gas sectors - created a landmark change in the early 2000's. This Investment Policy Review illustrates the important progress made by the government of Mozambique in improving its investment climate over recent years. It highlights major initiatives and specific policy measures undertaken, as well as areas that need further reforms to attract more and better investment, both domestic and foreign. While numerous policy advances have been achieved, such as the elimination of many foreign investment restrictions and the elaboration of a regulatory framework for public-private partnerships, the Review identifies remaining challenges. These include an insufficiently transparent and predictable investment regime, large infrastructure gaps which especially hinder smaller entrepreneurs, and weak communication channels between public and private sectors.

Book excerpt: The International Development Law Organization (IDLO) and the Center for International Forestry Research (CIFOR) assessed the legal frameworks that govern land-use activities and investments in Mozambique. Mozambique’s legal framework for environmental management is well developed, and recent legal reforms have strengthened key public interest safeguards. Similarly, the country has established a comprehensive framework for investment through the Investment Law and Investment Promotion Centre (CPI), and enshrined in the Land Law the right to the use and benefit of land (DUAT). The Environmental Impact Assessment (EIA) process places public consultation at the heart of effective environmental management. It extends participation to a broad spectrum of stakeholders at an early stage, allowing, in theory, substantial influence over the design and implementation of the EIA process. The National Council for Sustainable Development (CONDES) and the Ministry for Environmental Coordination (MICOA) have not managed, however, to influence high level government policy decisions and push convincingly for a sustainable development agenda.

Book excerpt: This review, which was prepared in response to Kazakhstan's 2012 request to adhere to the Declaration on International Investment and Multinational Enterprises (OECD Declaration), analyses the general framework for investment as well as most recent reforms, and shows where further efforts are necessary. It assesses Kazakhstan's ability to comply with the principles of openness, transparency and non-discrimination and its policy convergence with the OECD Declaration, including responsible business conduct practices. Capitalising on the OECD Policy Framework for Investment, this review studies other policy areas that are of key relevance to investment such as SME policy, infrastructure development, trade policy as well as anti-corruption efforts. Since the first review of Kazakhstan, in 2012, the authorities have made strides in opening the country to international investment and in improving the policy framework for investment as part of their efforts to diversify the economy to avoid continued overreliance on oil. Additional policy measures are nevertheless required to create a stimulating environment for investment if the government wants to fulfil its goal of economic diversification and sustainable development.

Book excerpt: This Fiscal Transparency Evaluation report highlights that Mozambique’s program of budget reforms has brought most aspects of its fiscal reporting and budgeting practices into line with basic and good practices, as defined under the IMF’s Fiscal Transparency Code. The weaknesses on fiscal reporting could be addressed on the short term by the on-going reforms. The disclosure and management of fiscal risks are inadequate and should be improved on the medium term to face the challenges that may arise from the expected increase in natural resource revenues. This report also describes several areas in which Mozambique’s fiscal transparency practices could be further improved. The institutional coverage of fiscal reports is still limited; it does not provide complete and reliable information on the operations performed by the social security fund and numerous autonomous entities, which are likely to be significant. The government’s fiscal reporting is prepared on a modified cash basis, and important elements of the balance sheet, such as the current value of arrears and of shares of corporations owned by the State, are not reported. Based on the analysis, this report makes seven recommendations aimed at materially enhancing the information base for fiscal decision-making in Mozambique and ensuring the country keeps pace with evolving international transparency standards and practice.
