Rather, we should analyze and interpret the events that have occurred in Iraq and try to remedy the situation by evaluating every possible option to achieve stability in the country. The term ‘fighting the flea’ derives from a book written by Robert Taber, an investigative journalist, after witnessing first-hand Fidel Castro and his revolutionaries wage a successful insurgency against the Batista government in the mid-1950’s and effectively take over the country.

It sought to engage Iraqi society in ways that would defeat any challenge to that state building project and U.S. guidance of it. Eric Herring and Glen Rangwala argue that state building in Iraq has been crippled less by preexisting weaknesses in the Iraqi state, Iraqi sectarian divisions or U.S. policy mistakes than by the fact that the US has attempted-with only limited success-to control the parameters and outcome of that process. They explain that the very nature of U.S. state-building in Iraq has created incentives for unregulated local power struggles and patron-client relations. Corruption, smuggling, and violence have resulted. The main legacy of the US-led occupation, the authors contend, is that Iraq has become a fragmented state-that is, one in which actors dispute where overall political authority lies and in which there are no agreed procedures for resolving such disputes. Great powers are equipped to fight other great powers in great battles over large territory. Rebels fight shadow wars, neutralizing the fire power and mobility of the occupying army. Insurgencies continue for years, allowing political considerations to come into play, including propaganda, international pressure, and the stream of dead and wounded returning from the war zone. The home front turns against the war, and new policymakers conclude that the nation's interests are best served by getting out. History is not an exact science, so the judgment here is expressed in probability, not certainty; witness the British defeat of insurgencies in Malaya and Kenya before giving up these colonies, and the four-decades-old Israeli occupation and partial colonization of the West Bank.

Book excerpt: This article seeks to chart the evolution of the idea of a legitimate resistance to occupation under international law to see how it can be applied to the Iraqi context. Its starting point is the proposed amnesty for insurgents and Iraq, and the reaction to it in the US. If it is indeed the case that the invasion of Iraq was illegal under international law, then what is the status of the resulting resistance to an illegal occupation, and why do international lawyers seem to have so little relevant to say on the matter? The article assumes that we are dealing with a "virtuous" insurgent movement in that no terrorist methods are used (this is arguably the case of at least some insurgent movements in Iraq). Different historical phases of recognition of a right to resistance are identified, from late nineteenth century crafting of the laws of war to recognition of national liberation movements during decolonization. Whatever foothold a "right to resist foreign occupation" achieved then, the article identifies a number of factors that compromise a more secure role for legitimate resistance, including the fact that "transformative" jus post bellum reform is increasingly seen as a legitimate goal of occupation, with the result that insurgency is seen as increasingly problematic. The article then attempts to throw the theoretical and legal foundations of what might be a more just recognition of the role of insurgents in some circumstances as part of a radically decentralized model of the enforcement of international law. It finds that a growing recognition of the role of non state groups in conflicts and a more general conception of the right of self defense can allow us to rethink the conditions of legitimacy of insurgency. The article concludes with a few thoughts borrowed from theories of "militant democracy" about how international law could become more sanguine about its own enforcement, and see non state actors, including occasionally ones using violence, as part of the total process by which the international order comes into being.
