O livro se desenvolve em três capítulos abordando a teoria moderadora dentro da divisão orgânica de poder, sendo que a primeira parte trata da teoria de Benjamin Constant, ou seja, sua conceitualização de Poder Neutro na estrutura do sistema constitucional. O segundo capítulo tem como vetor a implantação do Poder Moderador na Constituição do Império de 1824, quando instituiu o quarto poder de forma inédita no universo constitucional. Já a última parte trata do Poder Moderador na República, ou seja, a proposta de reinserção desse poder na Assembleia Constituinte de 1933 por Borges de Medeiros. Ainda nessa terceira parte, discutir-se-á a recolocação hodierna do tema do Poder Moderador como uma atribuição das Forças Armadas, todavia a tese foi rechaçada pela suprema corte."

A experiência portuguesa do regime semipresidencial evoca também a teoria de Benjamin Constant. Eleito pelo sufrágio direto, o Presidente português é dotado de capacidade de unificação social. Na Espanha, o Rei possui significativa autoridade, cujo valor é reconhecid.

Should the military be totally subordinate to the polity? Or should the armed forces be allowed autonomy in order to provide national security? Recently, the dangers of military dictatorships-as have existed in countries like Panama, Chile, and Argentina-have become evident. However, developing countries often lack the administrative ability and societal unity to keep the state functioning in an orderly and economically feasible manner without military intervention.Societies, of course, have dealt with the realities of these problems throughout their histories, and the action they have taken at any particular point in time has depended on numerous factors. In the ""first world"" of democratic countries, the civil-military relationship has been thoroughly integrated, and indeed by most modern standards this is seen as essential. However, several influential Western thinkers have developed theories arguing for the separation of the military from any political or social role. Samuel Huntington, emphasized that professionalism would presuppose that the military should intervene as little as possible in the political sphere. Samuel E. Finer, in contrast, emphasizes that a government can be efficient enough way to keep the civil-military relationship in check, ensuring that the need for intervention by the armed forces in society would be minimal. At the time of the book's original publication, perhaps as a consequence of a post-World War II Cold War atmosphere, this was by no means a universally accepted position. Some considered the military to be a legitimate threat to a free society. While "Brazil" had geographic meaning, it did not constitute a cohesive political identity that could draw on basic loyalties. The tumultuous struggle to nationhood in Brazil was marked by the interplay of differing social groups, political parties, and regions. A series of violent revolts in Pernambuco, a large slaveholding, sugar-producing province in northeastern Brazil, exposed the tensions accompanying state and nation building. Political Struggle, Ideology, and State Building delves into the complex and engaging history of the contested province of Pernambuco, providing better understanding of the interplay between local and provincial social and political struggles and the construction of the nation-state. Jeffrey C. Mosher reevaluates political parties, institutions long assumed to be mere facades for elite factions with identical interests. He demonstrates the importance of both formal political institutions and ideology, as well as the efforts of the lower classes to assert their own visions and values. Resentment of the Portuguese provided common ground for some elite factions and lower-class groups and figured importantly in defining the nation. Mosher's analysis clarifies how the lower class's assertiveness--in a society sharply divided by slavery, race, and class--frightened various elite groups into embracing both exclusionary discourses on race and the need for authoritarian, centralized political institutions, a development that proved to be an enduring legacy of the period.

It sets out the following aspects of the constitutional development and erosion: - the different phases of the promised transition from military rule to a 'social-democratic constitutionalism'; - the obstacles to democratisation derived from the absence of true institutional reforms in the judicial branch and in the civil-military relationship; - the legal and social practices which maintained a structure that obstructed the emergence of an effective social-democracy, such as the neoliberal pattern, the acceptance in the political field of unlawful organisations, such as the milícias, and the way the digital revolution has been harming the formation of democratic sovereignty. Situating Brazil in the global context of the revival of authoritarianism, it details the factors which are common to the third wave of democratisation reflux. Accounting for those aspects, particular to the Brazilian jurisdiction, it shows that there is a tension in the Brazilian constitution. On the one hand, such constitutionalism was renewed by democratic pressure on governments to undertake social politics since 1988. On the other hand, it retained authoritarian practices through the hands of diverse institutions and political actors.
