Assim, com o objetivo de desenvolver e aprimorar o tema, enfrenta-se o seguinte problema: o controle judicial da representação adequada, no incidente de resolução de demandas repetitivas, pode e deve ser realizado, mesmo não estando expressamente previsto no ordenamento jurídico brasileiro? No presente estudo, defende-se que o controle da representação adequada é requisito para a constitucionalidade do incidente, de modo a ser conferida uma interpretação ao instituto conforme a Constituição, para assegurar o respeito ao devido processo legal.

Book excerpt: O livro propõe analisar a influência da decisão do Incidente de Resolução de Demandas Repetitivas, sob a administração pública, mais especificamente aos entes, órgãos e agências reguladoras que serão atingidos pela formação da tese jurídica a ser fixada no respectivo incidente. Com a ineficiência do Estado, há perceptível crescimento da judicialização, em que questões cada vez mais relevantes estão sendo decididas pelo Judiciário. Por outro lado, esse efeito acarretou a massificação dos conflitos, gerando necessidade de se reconhecer direitos com dimensão predominantemente coletiva para contribuir no tratamento da disseminação de direitos individualizados, que possuem traços de homogeneidade entre si. Entretanto, o livro demonstrará que os mecanismos coletivos criados pelas legislações foram insuficientes para combater o litígio de massa, não conseguindo conter a multiplicação das ações promovidas. Portanto, foi preciso que se criasse o Incidente de Resolução de Demandas Repetitivas para propiciar o processamento e julgamento de demandas de massa de forma adequada. Esse instrumento, no entanto, por possuir forte caráter vinculante perante o judiciário e a administração pública, tem sido objeto de questionamento quanto à violação ao princípio da separação dos poderes. Em que pese pairar dúvida sobre a sua constitucionalidade, esta obra demonstrará que o incidente busca quebrar o paradigma tradicional da separação dos poderes, propondo realizar uma integração entre os poderes.
