No presente estudo, defende-se que o controle da representação adequada é requisito para a constitucionalidade do incidente, de modo a ser conferida uma interpretação ao instituto conforme a Constituição, para assegurar o respeito ao devido processo legal.

Entretanto, o livro demonstrará que os mecanismos coletivos criados pelas legislações foram insuficientes para combater o litígio de massa, não conseguindo conter a multiplicação das ações promovidas. Portanto, foi preciso que se criasse o Incidente de Resolução de Demandas Repetitivas para propiciar o processamento e julgamento de demandas de massa de forma adequada. Esse instrumento, no entanto, por possuir forte caráter vinculante perante o judiciário e a administração pública, tem sido objeto de questionamento quanto à violação ao princípio da separação dos poderes. Em que pese pairar dúvida sobre a sua constitucionalidade, esta obra demonstrará que o incidente busca quebrar o paradigma tradicional da separação dos poderes, propondo realizar uma integração entre os poderes.
