Contudo, a questão que se coloca é de que forma ele pode ser regularmente exercido. Nesse sentido, a contribuição deste estudo consiste em realizar uma análise prospectiva acerca de como deve ser a melhor atuação da Administração nos casos concretos, assim como sobre a revisão dos atos administrativos pelo Poder Judiciário. Uma recente alteração legislativa modificou a Lei de Introdução às Normas do Direito Brasileiro (Decreto-Lei Federal no 4.657/1942), tornando obrigatórias tanto a análise dos casos concretos quanto a correspondente fundamentação quando da realização do ato administrativo. Tal modificação vem ajustando a prática ao anseio da sociedade, que clama por atos que possam atender aos interesses coletivos através das escolhas regularmente exercidas. Acreditamos que, além de existir um controle dos atos administrativos pelo Poder Judiciário cada vez mais profundo, a própria Administração deve verificá-los através de parâmetros mais claros e objetivos.

À Administração Pública é conferido poder discricionário pelo ordenamento jurídico, para, ante o caso concreto, adotar a melhor conduta, a que atenda a vontade da lei. A faixa da discricionariedade contém limites a serem observados pelo administrador. Essa faixa, entretanto, é invisível. Essa invisibilidade contribui para que o agente público no exercício do poder discricionário pratique atos contrários à vontade da lei, contrariando interesses particulares ou beneficiando particulares contrariando o interesse público. O mérito do ato administrativo decorrente da discricionariedade é a conveniência ou a oportunidade. Esse poder de escolha, de eleição da conduta a ser adotada, conferido ao administrador, no entendimento da doutrina e da jurisprudência ainda dominantes refoge ao controle do Judiciário. A obra, fundada em ampla pesquisa doutrinária e jurisprudenciária pátrias e estrangeiras, sustenta com sólidos argumentos e provas que ao Poder Judiciário é conferida competência para controlar o mérito do ato administrativo, sem configurar hipótese de invasão de competência do Poder Executivo.

Como processo administrativo cujos requisitos previstos estão em lei e em atos normativos infralegais, o concurso será passível de controle pela própria Administração Pública (autotutela), bem como pelo Poder Judiciário quanto aos aspectos da juridicidade, sendo tal controle ampliado no Estado Social Democrático.

Thirty-five years later, the actual administrative practices of the country did not adequately reflect the philosophy underlying this movement, a philosophy drawn from the reform experience and public administration theories of the United States and Western Europe. This book examines why these ideas, when transplanted to another cultural setting, did not take root and, further, why they unexpectedly proved to be most applicable in Brazil during periods of autocratic rule. These questions are highly relevant not only to Brazil, but equally to other developing countries struggling to create more effective national administrative systems. For this reason, and in order to evaluate the Brazilian reform experience within its total context (social, economic, and political), Lawrence S. Graham develops a broad conceptual framework. His focus is on the years between 1945 and 1964, a period which allowed a relatively free play of political forces but, ironically, produced a diminution in the success of the reform efforts when compared with the authoritarian governments which preceded and followed it. After a comparative consideration of the public administration theories behind the reform movement, Graham examines this period in terms of the political environment, the functions of political patronage, and the influences of a nascent national party. Finally, he juxtaposes the conditions and course of the Brazilian reform experience with those of the United States and Great Britain. Graham’s study of the Brazilian example, which does not pass judgment on the prevailing public personnel system, reveals the importance of understanding the total cultural context within which administrative principles are put into practice. Such an approach, wider than generally held in the field of public administration, may prove to be the most vital factor in the future of the civil service in Brazil and several other countries facing the same problems.
