It traces the origins of thinking on the subject from the creation of the Corpus Inscriptionum Latinarum through the political and social movements of the 19th and 20th centuries in Western Europe. The bulk of the book focuses particularly on the intersection of scholarship and economic theory in Fascist Italy, as the collegia were analysed by the Istituto di Studi Romani, incorporated into the Mostra Augustea della Romanità, and ultimately championed by the Minister of National Education, Giuseppe Bottai, in 1939.

Book excerpt: Amongst the oldest universities that of the Roman curia is the Great Unkown; little is known of the university of Rome (and of Avignon till 1378). To compensate the loss of sources materials mainly from the Vatican were intensively analysed and a prosopography of the dons and students (694 biograms in annex) drawn up. Some results: all three were legal universities of the southern type. The curial university was itinerant, it was continued at the general councils. Only when the curia resided there untroubled, the local schools of Rome (and Avignon) became great, international universities and different forms of association with the curial university were tried on. Rome was sought after by students from all over Europe for study of legal theory whereas praxis was learned at the papal court. Another attraction of Rome were the possibilities of attaining higher academic grades without much ceremony (first in theology, later also in law).

Book excerpt: L’intento sotteso alla realizzazione del presente volume – che si ricollega a precedenti studi realizzati nel corso degli anni – è quello di ripercorrere sinteticamente i tratti fondamentali della storia costituzionale romana individuando, al contempo, “forme concettuali” e “prassi consolidate” che, seppur sviluppate in quell’esperienza storica, hanno segnato anche le sorti di tutta la Tradizione giuridica successiva, e pertanto, dell’intera Tradizione giuridica Occidentale . Si tratta, infatti, di «uno strato tenacissimo di concetti e di pratiche» che hanno raggiunto «quei laboratori politici e istituzionali dei cui prodotti siamo i diretti eredi», secondo un percorso «di lunghissima durata e di portata tendenzialmente universale» . Le forme concettuali del diritto romano sono state inserite nella scienza giuridica di ogni paese, a prescindere dalle diverse concezioni del diritto vigenti nei vari momenti storici (giusnaturalismo, razionalismo e così via) producendo «un inventario di concetti fissi tradotti in ogni lingua europea», che ha fatto sì che il diritto romano diventasse «un vocabolario comune, la lingua della comunità della scienza giuridica, il modello riconosciuto del lavoro concettuale giuridico e, in tal modo, un common law concettuale e spirituale europeo, senza il quale non sarebbe neppure teoricamente possibile una comprensione fra i giuristi delle diverse nazioni». Ne è derivata la conseguenza che le «matrici comuni del diritto europeo – tanto di civil law, quanto di common law – stanno nel diritto romano: o meglio nella dottrina o scienza giuridica (Recthswissenschaft) romana», in quanto «nella recezione del diritto romano ... non si è trattato semplicemente della recezione di un diritto, ma della recezione di una scienza giuridica». Una Recthswissenschaft che ha determinato una Rechtsgemeinschaft, una “scienza giuridica”, dunque, che ha determinato una “comunità di diritto” che comprende tutti quei territori e comunità in cui il diritto romano è stato applicato o studiato. Ed è proprio questa la ragione che ha determinato il valore paradigmatico del diritto romano nell’ambito dell’esperienza giuridica occidentale, e il valore paradigmatico della stessa nell’ambito dell’esperienza giuridica mondiale . Esiste pertanto una scienza giuridica che costituisce il presupposto di un’identità giuridica europea comune che trova la sua matrice più profonda nel diritto romano, o meglio nella scienza giuridica romana, e che svolge ancora oggi un ruolo determinante nell’ambito del sistema giuridico mondiale. D’altronde – nella storia della tradizione giuridica occidentale – i concetti, le categorie, i principi, i modelli derivanti dal diritto romano non hanno fornito “soluzioni giuridiche”, ma hanno contribuito principalmente a orientare l’attività degli interpreti in connessione all’esigenza di predisporre e articolare modelli teorici di comprensione della realtà giuridica, che si ponessero anche come strumenti concreti di razionalizzazione della stessa. Così, oggi, l’identificazione di uno “strumentario concettuale comune della scienza giuridica europea”, non ha finalità meramente teoriche ma è funzionale al rafforzamento del dialogo e dell’integrazione. L’intento non è quello di individuare somiglianze o differenze in modo descrittivo, ma quello di individuare strumenti comuni di dialogo, confronto e interazione tra giuristi. Così, recentemente Alpa in maniera significativa afferma che «il diritto romano ha molto da dire ai giuristi del nostro tempo», non esitando a riconoscere che «il diritto romano è relativizzato, ma anche riconosciuto come fonte ispiratrice delle culture giuridiche di tutti i paesi dell’Occidente, anche quelli che, almeno apparentemente, se ne sono distaccati molti secoli fa ... La storia europea ne è intrisa in modo indelebile. Il diritto romano costituisce dunque un “bene comune” ed un valore universale». Pertanto, come ci ricordano i nostri Maestri «... in nessun momento storico la concezione della storicità del diritto si è imposta al pensiero giuridico come nel presente, dimostrandosi l’unica idonea a spiegare, oltre se stessa e il proprio fondamento, anche altre posizioni, in ciò che implicano, nei condizionamenti che le determinano e in quelli che esse generano ... Tutto il bagaglio tradizionale dei concetti su cui si è fondata per secoli e millenni la conoscenza giuridica viene a prospettarsi, infatti, negli studi più nuovi e vivi sotto un profilo rilevatore: precisamente come materia di conoscenza e pertanto oggetto, anch’esso, di indagine. Un’indagine rivolta non solo a ricercare dietro i concetti la vita, ma pure la storicità dei concetti stessi e le loro connessioni con la vita che attraverso di essi e in essi si esprime».

Book excerpt: The Italian scholar Giovanni Battista Vico is widely viewed as the first modern philosopher of history, a judgment largely based on his obscure 1744 masterpiece, New Science. In this new study Mark Lilla complicates this picture by presenting Vico as one of the most troubling of anti-modern thinkers. By combing Vico's neglected early writings on metaphysics and jurisprudence, Lilla reveals the philosopher's deep reservations about the modern outlook and shows how his science of history grew out of these very doubts. In works such as the untranslated Universal Right (1720-1722), a treatise on natural law, Vico emerges as a profoundly political and theological thinker who contrasted the authoritative traditions of an idealized Rome against the corrupting skepticism endemic in modern life. Vico explicitly blamed this skepticism on the founders of modern philosophy, particularly Descartes. Placed in the context of his critique of skepticism, Vico's "new science" of history appears in a wholly new light. Though modern in form, it can be seen here for what it was: a pessimistic vindication of divine authority directed against the freedom and reason that characterize the modern age. This first truly comprehensive introduction to Vico ties his concerns for authority, politics, and civil religion to his theory of history. As such, it raises provocative questions about the subsequent intellectual development of the anti-modern tradition as it relates to the historical and social sciences of our time. It is a brilliant antidote to the "standard" reading of Vico and will transform studies of his work.
