Book excerpt: Legal Issues of Digitalisation, Robotization and Cyber Security in the Light of EU Law By Nadežda Šišková, (ed.) The current extremely rapid and dynamic development of modern technologies and the unprecedented degree of their integration into the everyday life of every person are radically changing the previous modus vivendi in the society. The emergence of the Internet and the continuous development of digital technologies have brought into fore a number of new legal problems and issues that require a timely solution and proper and effective legal regulation by the EU as one of the leading regulators of the digital world. The technological developments have opened a new “window” to the borderless world of the Internet, giving a person an opportunity to exercise his/her fundamental rights at a new and unprecedented level. This unique book thus presents the key information and solves the related problems concerning the legal regulation of the usage of modern technologies in everyday life. The book is conceived in a form of a collective monograph prepared by an international team of renowned researchers from famous European Universities (Heidelberg University, Palacky University in Olomouc, Tallinn University of Technology, Comenius University in Bratislava and Shevchenko University in Kyiv) and scientific legal societies as well as top-level experts from practice. This team is representing the countries with the highest level of integration of modern technologies (Estonia, Germany, Czech Republic, Slovakia) or has a unique experience with provision of cyber security in the extreme conditions. The book creates a main output from the research project with the title “The EU and the Challenges of Modern Society (legal issues of digitalization, robotization, cyber security and prevention of hybrid threats)” granted by the EACEA in the category of Jean Monnet network. The publication of the book is supported by the financial subsidy in the amount of 3 000 Euro, sent by Palacky University to the Publisher (Intersentia). Topics that the authors focus on: - The European approach to the right to Internet access - Artificial Intelligence and the Challenges for the Theory of Human Rights - GDPR and the Right to Personal Data and Privacy in a Modern Society - Consumer Protection in the on-line World Future challenges in consumer protection - Competition Law in a Digital Economy - EU Regulation of On-line Platforms - Pricing Algorithms and Anticompetitive Agreements - EU legal framework of software security vulnerabilities - New Cybersecurity Rules for Markets in Crypto-Assets in the EU Law The primarily readers/users are: - legal experts in European law - legal researchers and scientific societies dealing with EU matters, - IT specialists, - personal data specialists, - scholars and students in European countries and America (UK, USA, EU and candidate countries, etc.). - compulsary source for students the Palacky University (Czech Republic), Heidelberg University (Germany), Talin Techinic University (Estonia), Comenius University in Bratislava (Slovakia), Kyiv Shevchenko University (Ukraine) Benefits: - the analysis of the most important and thorny legal issues of the process digitalisation, robotization and providing of cyber security - the proposals de lege ferenda concerning the optimal ways of legal regulation of the mentioned process Great number of key legislative acts were adopted at the level of the EU. The conclusions will summarise the key ideas of the authors and the proposals de lege ferenda concerning the whole text. The same refers to the preface, which will be prepared by the Vice-President of the European Commission Vera Jourová (responsible for Values and Transparency) which will relate to the whole text.

Available in PDF, EPUB and Kindle. Book excerpt: Posthumanism represents a significant new research direction both for International Relations and the social sciences. It emerges from questions about inter-species relations which challenge dominant perceptions of what it means to be human. Rather than seeing the human species as ‘in nature’ posthumanist thinking considers the species as ‘of nature’. The work of posthumanist thinkers has sought to dispute accepted notions of what it means to be human, raising profound questions about our relations with the rest of nature. The volume commences with an overview of the influence thinkers have had on the development of posthumanist thinking. Key ideas in International Relations are interrogated and reconceptualised and specific case studies are presented with a focus on inter-species relations. The work allows for a consideration of the limits of the posthumanist move and provides space for critics to argue that such an approach opens the discipline up to a biological determinism, and that a focus on inter-human relations should mark the boundaries of the discipline. The essays collected in this volume provide an overview of contributions from posthumanist thinkers with the particular intention of providing a succinct introduction to the area and should appeal to scholars and students in Politics, IR and philosophy.

This book was released on 2016-10-17 with total page 342 pages. Available in PDF, EPUB and Kindle. Book excerpt: All are agreed that the digital economy contributes to a dynamic evolution of markets and competition. Nonetheless, concerns are increasingly raised about the market dominance of a few key players. Because these companies hold the power to drive rivals out of business, regulators have begun to seek scope for competition enforcement in cases where companies claim that withholding data is needed to satisfy customers and cut costs. This book is the first focus on how competition law enforcement tools can be applied to refusals of dominant firms to give access data on online platforms such as search engines, social networks, and e-commerce platforms – commonly referred to as the ‘gatekeepers’ of the Internet. The question arises whether the denial of a dominant firm to grant competitors access to its data could constitute a ‘refusal to deal’ and lead to competition law liability under the so-called ‘essential facilities doctrine', according to which firms need access to shared knowledge in order to be able to compete. A possible duty to share data with rivals also brings to the forefront the interaction of competition law with data protection legislation considering that the required information may include personal data of individuals. Building on the refusal to deal concept, and using a multidisciplinary approach, the analysis covers such issues and topics as the following: – data portability; – interoperability; – data as a competitive advantage or entry barrier in digital markets; – market definition and dominance with respect to data; – disruptive versus sustaining innovation; – role of intellectual property regimes; – economic trade-off in essential facilities cases; – relationship of competition enforcement with data protection law and – data-related competition concerns in merger cases. The author draws on a wealth of relevant material, including EU and US decision-making practice, case law, and policy documents, as well as economic and empirical literature on the link between competition and innovation. The book concludes with a proposed framework for the application of the essential facilities doctrine to potential forms of abuse of dominance relating to data. In addition, it makes suggestions as to how data protection interests can be integrated into competition policy. An invaluable contribution to ongoing academic and policy discussions about how data-related competition concerns should be addressed under competition law, the analysis clearly demonstrates how existing competition tools for market definition and assessment of dominance can be applied to online platforms. It will be of immeasurable value to the many jurists, business persons, and academics concerned with this very timely subject.

Available in PDF, EPUB and Kindle. Book excerpt: This book sets out the big data landscape, comprising data abundance, digital connectivity and ubiquitous technology, and shows how the big data landscape and the emerging technologies it fuels are impacting national security. This book illustrates that big data is transforming intelligence production as well as changing the national security environment broadly, including what is considered a part of national security as well as the relationships agencies have with the public. The book highlights the impact of big data on intelligence production and national security from the perspective of Australian national security leaders and practitioners, and the research is based on empirical data collection, with insights from nearly 50 participants from within Australia’s National Intelligence Community. It argues that big data is transforming intelligence and national security and shows that the impacts of big data on the knowledge, activities and organisation of intelligence agencies is challenging some foundational intelligence principles, including the distinction between foreign and domestic intelligence collection. Furthermore, the book argues that big data has created emerging threats to national security; for example, it enables invasive targeting and surveillance, drives information warfare as well as social and political interference, and challenges the existing models of harm assessment used in national security. The book maps broad areas of change for intelligence agencies in the national security context and what they mean for intelligence communities, and explores how intelligence agencies look out to the rest of society, considering specific impacts relating to privacy, ethics and trust. This book will be of much interest to students of intelligence studies, technology studies, national security and International Relations.

Available in PDF, EPUB and Kindle. Book excerpt: Intellectual property refers to exclusive rights in, among other things, inventions (patents), works of authorship (copyright), and source-identifying symbols (trademarks). Intellectual property law is generally viewed as a means for inducing the optimal supply of inventions, works, and symbols. Economics provides some useful tools for determining whether the legal rules at issue are more or less likely to achieve this goal. This book in particular addresses the law and economics of a variety of topics that have been underanalyzed in the existing literature, including remedies such as injunctions and damages, the relevance of the defendant's mental state, and matters relating to the enforcement of intellectual property rights in court proceedings.

Book excerpt: This book explores slash fan fiction communities during the pivotal years of the late 1990s and early 2000s as the practice transitioned from print to digital circulation. Delving into over ten years of online and in-person ethnography, the book offers an in-depth examination of slash fan fiction – original stories written by and circulated within female-centered communities about same-sex characters borrowed from previously published sources – to document the history of a feminist, queer media subculture whose infrastructure, creativity, and ways of life are often obscured in dominant histories of the internet’s development and by the contemporary focus on industry-friendly but often misogynist digital fan subcultures. Arguing that online slash communities created an alternate public space that provided opportunities for unanticipated encounters with a wide range of complex sexual, relational, and political practices, the book contends that slash thereby added to readers’ tools for experiencing and thinking about pleasure and ways of living by forming a “pocket public,” that is a digital space public enough to be found and protected enough to shield participants from harassment and censorship. This insightful and comprehensive study will interest students and scholars working in the areas of media studies, literary studies, anthropology, new media, audience communities, convergence culture, fan studies, women’s studies, and queer studies.
