Available in PDF, EPUB and Kindle. Book excerpt: Africa is endowed with commercially viable quantities of several minerals and metals, and, more than ever before, African countries wish to harness their mineral resources for their economic development. The African mining sector has witnessed a revolution in terms of new mining codes and amendments to extant mining codes, which are designed to achieve a multitude of objectives, including the assertion of greater control over exploitation of mineral resources; optimization of resource royalties and taxes; promotion of equity participation in mining projects; enhancement of indigenization in the form of domestic participation in mineral production and local content requirements; value addition and beneficiation in terms of domestic processing of raw mineral ores and metals in Africa; and the promotion of sustainable practices in the mining sector. This book analyzes the legal and fiscal frameworks for hard-rock mining in several African countries including Botswana, Democratic Republic of Congo, Ethiopia, Ghana, Guinea, Kenya, Namibia, Nigeria, Liberia, Tanzania, Sierra Leone, South Africa, South Sudan, Zambia, and Zimbabwe, with reference to other resource-rich countries. It engages in a comparative analysis of mining statutes in Africa with regard to topics such as the acquisition of mineral rights; types of mineral rights; the nature of mineral rights; the rights and obligations of mineral right holders; security of mineral tenure; surface rights; fiscal regimes including royalty and tax regimes; resource nationalism in the mining sector; management and utilization of mining revenues including benefit-sharing arrangements between mining companies and host communities; environmental stewardship; and sustainable exploitation of mineral resources.

Available in PDF, EPUB and Kindle. Book excerpt: This handbook is a product of the challenges experienced by potential investors in Nigeria. The key challenge we have witnessed is that there is a gap in accessing relevant information and resource material in key sectors of the country. Access to reference guides is most important, particularly to foreign investors who require an understanding of the sectors they want to invest in prior to coming into the country. This handbook is therefore intended to serve as a resource material and a reference guide to investors, businessmen and women, Chambers of Commerce, legal practitioners, and anyone interested in knowing the requirements for participation in any of the listed sectors in Nigeria. The handbook makes reference to Nigerian legislation and the relevant sections of the law on permit and licensing requirements within the listed sectors. This handbook covers the major sectors with attractive investment appeals, and thus, it takes account of a broad spectrum of the sectors in country, such as insurance; aviation; taxation; electronic money transfer/payment systems; registration of courier services and clearing and forwarding agents; maritime, including registration of ships; energy/power; solid minerals; oil and gas, including issues bordering on local content development; entertainment; licensing and censorship; radio; sound; television; cable or satellite station; intellectual property, specifically, the registration of trademark, patents, copyrights, and designs. Theres also telecommunication licenses; environmental standards and regulations that impact upon operating a business in Nigeria; immigration, including obtaining expatriate quotas; residence permits; and licensing and regulation of private guard companies in Nigeria, etc. It must be pointed out that the handbook does not intend to override or remove the need to consult a legal practitioner with an understanding of the Nigerian legal system when appropriate. Nonetheless, the handbook will provide useful information to its audience.

Book Synopsis License to Drill by : Cari L. Votava
Download or read book License to Drill written by Cari L. Votava and published by World Bank Publications. This book was released on 2018-08-07 with total page 159 pages. Available in PDF, EPUB and Kindle. Book excerpt: Natural resources have the transformational potential to support economic and political stability as well as contribute to national prosperity and economic development. However, in countries dependent upon natural resource sectors, poor management of these sectors often contributes to corruption, illicit financial flows (IFFs) and thus, poverty. Adequate transparency and accountability in regulatory management of these sectors is a challenge for resource rich countries. Poor licensing decisions in natural resource management can open a pandora’s box of corruption risks. This manual provides methods and options based on good practices to improve transparency, accountability, and integrity in the regulatory licensing process and integrity due diligence. The manual borrows models from the Basel Core Principle ‘fit and proper’ concept, and provides options for conducting effective (a) beneficial ownership; (b) criminal/legal; and (c) conflicts of interest checks, with a goal of integrating these into the regulatory licensing process. The manual also identifies common legal framework defects that can facilitate corruption risks, and offers options based on principles of regulatory integrity to reduce these risks. The good practices identified can help countries allocate limited financial resources in conducting thorough background checks in a cost-effective manner, as well as meet EITI’s requirements for public disclosure of beneficial owners and politically exposed persons. These strategies for reducing opportunities for corruption in extractive sectors can help reduce IFFs that can sap resources from the economy and inhibit a country’s ability to achieve the Sustainable Development Goals.
