Book excerpt: Last year I addressed the Netherlands Comparative Law Asso ciation with the following question: 'Does Comparative Law Exist At All?' (My intention then was to flog the dead (?) horse of the merger of comparative law and the sociology of law. ) In presenting this voluminous collection of Netherlands national reports to the eleventh congress of the Internatio nal Academy of Comparative Law I feel my misgivings giving way to the suspicion, that comparative law indeed exists. Of course national reports do not, as such, prove the exist ence of comparative law. It is the general reports together with the national reports, which embody the comparative effort. That is why the Netherlands Comparative Law Associa tion took the initiative to propose the publishing of the materials on a subject to subject basis instead of publish ing collections of national reports. From a comparative legal point of view, it is the topic that should form the basis of the publication, and not the origin of the materials. The general reporter for each topic should be prepared to take up the responsabilities of editing the volume, and would have to be given the right to select those national reports which he considers to be useful both in regard to their quality and the relevance of the material to the basic problems in the questionnaire. This proposal met with very favourable comments from the na tional committees and general reporters of some fifteen coun tries.

Download or read book Introduction to Dutch Law written by Larissa van den Herik and published by Kluwer Law International B.V.. This book was released on 2022-01-27 with total page 1049 pages. Available in PDF, EPUB and Kindle. Book excerpt: A standard legal resource since its first edition in 1978, this matchless book has proven itself the ideal overview of Dutch law for foreign lawyers. This Sixth Edition fully updates its systematic description of the legal sources, institutions, and concepts in all major fields of law. Recent developments covered include the progressive implementation of standards set by international conventions, the reorganization of the judiciary, the statute on environmental law, and the (re)codification of private international law. The continuing influence of European law is evident in many fields, perhaps most notably in family law. The various chapters are written by experts – scholars and lawyers – in particular fields, and provide an authoritative overview of each field. The historical sources of Dutch law are discussed, as well as Dutch legal culture, legal philosophy, judicial organization, legal education, and the legal profession. These chapters are followed by introductions to essential issues of private and public law and labour law. The last chapter examines financial law. The only resource of its kind available, this book is unmatched as a thorough guide to further research. It offers practitioners, particularly foreign lawyers, a quick and reliable way into any area of Dutch law that they may be required to research. It will also be of great value to comparatists (especially those studying the influence of European law on national legal systems), scholars, and students. Like previous editions, the Sixth Edition has been prepared under the auspices of the Netherlands Comparative Law Association.

Book excerpt: This account of the anthropology of law is remarkable in its command of the Anglo-American and Continental literatures in this field; and it is timely in addressing contemporary issues. Two central projects are carried through in succesive parts of the book. In the first, the author outlines the history of the "anthropology of law," drawing on the intellectual context of legal development. In the second, Professor Rouland examines the legal ideas, institutions and processes of small-scale non-Western societies, moving finally towards an anthropology of modern law. The author has published widely within the field of legal anthropology.

Book excerpt: Almost twenty years after its first edition, and five years after its second edition, The long-awaited third edition of Introduction to Dutch Law is now available in both hardback and paperback. This edition has incorporated most of the major changes in Dutch law, such as the revisions in the Constitution in 1983. In the 1980s, The Dutch criminal justice system lost some of its liberal characteristics of the 1970s, and, finally, The publication of the third edition comes just after the new Civil Code and General Administrative Law Act have entered into force. The impact of European law has increased considerably And The growing importance of environmental law has justified devoting a full chapter to this subject. Moreover, a continuous stream of case law and legislation has also necessitated updating the book. All these changes have led to important modifications as compared To The first two editions. For practical reasons, The order of the chapters has remained virtually unchanged. The 23 chapters in the book are divided into five parts: The Dutch Legal System, Private Law, Public Law, Labour Law and Legal Philosophy. In order to increase its usefulness for foreign students, The original --mainly Dutch-language--Bibliography has been extended to include a Bibliography of foreign publications on Dutch law. The editors have prepared this book under the auspices of the Netherlands Comparative Law Association. Many of the original contributors have collaborated in this revision; they have been joined by a new generation of comparative lawyers.

This book was released on 2001-06-22 with total page 744 pages. Available in PDF, EPUB and Kindle. Book excerpt: Comparativism is no longer a purely academic exercise but has increasingly become an urgent necessity for industrial relations and legal practitioners due To The globalisation of the economy, The massive introduction of new information technology, The growth of multinational enterprises And The impact of international and regional organizations aspiring to harmonize rules. the growing need for comprehensive, up-to-date and readily available information on labour law and industrial relations in different countries led To The publication of the International Encyclopaedia for Labour Law and Industrial Relations, In which almost 70 international and national monographs have been published thus far. This book goes a step further than the Encyclopaedia inasmuch as most of the chapters provide comparative and integrated thematic treatment. Our aim is to describe the salient characteristics and trends in labour law and industrial relations in the contemporary world. Encouraged by the warm reception of the first six editions, we hope that also the seventh edition will serve as a textbook and reference work to facilitate the task of teachers and students of comparative labour law and industrial relations. We hope, too, that the book will provide labour lawyers, HRM and industrial relations specialists with the necessary insights to cope with a world which is increasingly international.
