Book excerpt: In November 2011, the Supreme Court of Nepal ruled in favour of a fourth extension for the promulgation of the constitution. A final deadline of 27 May 2012 was set for the delivery of this mandate. However, once again the task has not been fulfilled and this stalemate will certainly push Nepal into a deeper political crisis. Inter- and intra-party politicking, ideological clashes and the inability to reach a consensus on the state's restructuring process on the basis of ethnic federalism have altogether hampered the major political parties from working together. Although some political headway has been made in the recent months, the transition to a federal democratic republic and the overall peace process in Nepal will remain incomplete if a constitutional crisis persists.

Book excerpt: "On 20 September 2015, Nepal's new constitution passed amid deadly protests by Madhesi and Tharu groups across the southern Tarai plains that continued for months, leaving 57 dead. Protesting groups said the statute backtracked on addressing structural discrimination. The protests had deep support in ethnic Madhesi Tarai communities, reflecting a profound, increasing sense of alienation from the state. A 135-day blockade of vital supplies by Madhesi civic and political groups, partially supported by India, has ended, but as no political solution is on the table, the protests are almost certain to resume. To stop violent polarisation and a breakdown of social relations, national parties and protesting groups must urgently agree on how to manage contentious issues, with timelines, guarantees, and a role for civic participation. A sustainable, equitable social contract is necessary for lasting peace and reconciliation"--Publisher's web site.

Book excerpt: Nepal's peace process was to end with a new constitution. Yet, after four years of delays and disputes, the country's main political parties were unable to agree on federalism, a core demand of large constituencies. On 27 May 2012, the term of the Constituent Assembly, which also served as parliament, ended without the new constitution being completed. The parties must now decide what to do next: hold an election for a new assembly or revive the last one. This will be hard. Obduracy on federalism, bickering over a unity government, a changing political landscape and communal polarisation make for complex negotiations, amid a dangerous legislative vacuum. The parties must assess what went wrong and significantly revise the composition and design of negotiations, or risk positions hardening across the political spectrum. Talks and decision-making need to be transparent and inclusive, and leaders more accountable. The public needs much better information. None of this will necessarily mend the deep social rifts, but it would reduce space for extremists and provocateurs.

Book Synopsis Constitutions in Times of Financial Crisis by : Tom Ginsburg
Download or read book Constitutions in Times of Financial Crisis written by Tom Ginsburg and published by Cambridge University Press. This book was released on 2022-06-30 with total page 342 pages. Available in PDF, EPUB and Kindle. Book excerpt: Many constitutions include provisions intended to limit the discretion of governments in economic policy. In times of financial crises, such provisions often come under pressure as a result of calls for exceptional responses to crisis situations. This volume assesses the ability of constitutional orders all over the world to cope with financial crises, and the demands for emergency powers that typically accompany them. Bringing together a variety of perspectives from legal scholars, economists, and political scientists, this volume traces the long-run implications of financial crises for constitutional order. In exploring the theoretical and practical problems raised by the constitutionalization of economic policy during times of severe crisis, this volume showcases an array of constitutional design options and the ways they channel governmental responses to emergency.
