Book Synopsis The Actors of Collective Bargaining by : Eduardo J. Ameglio
Download or read book The Actors of Collective Bargaining written by Eduardo J. Ameglio and published by Kluwer Law International B.V.. This book was released on 2004-01-01 with total page 366 pages. Available in PDF, EPUB and Kindle. Book excerpt: No one denies that the institution of collective bargaining between workers and employers has been a powerful tool for social dialogue. Without our history of effective collective bargaining there would be no mutual understanding, no industrial peace, no constructive cooperation between social partners. Yet there is a feeling today that this history has drawn to a close; that our post-industrial world demands something different, something our tradition of collective bargaining and collective agreements cannot give us. What information and insight can we gather to verify or challenge this feeling? This was the first major question addressed by the distinguished delegates to the twenty-seventh World Congress of Labour and Social Security Law held at Montevideo, 2'5 September 2003. The aim of the conference was to discover current problems regarding the existing structures and functions of collective bargaining in industrialized countries today'problems readily identifiable in the context of economic globalization, falling union density, the increase in atypical and knowledge-based workers, and the 'tertiarization' or declining economic importance of manufacturing-based industry. This bulletin contains some of the most important papers devoted to this major theme of the conference. It presents twenty national reports, each written by a scholar well-versed in the law and practice of collective bargaining in the country covered. Two introductory reports deal with such general issues as the varying competences of representatives under different legal systems, labor union representation within the public sector, the development of collective bargaining in EC law, the levels and structures of collective bargaining practice, and the widening gap between the relevant legal norms and real situations. The national reports were drafted on the basis of a questionnaire, which appears as an annex. This allows the reader to easily compare the solutions set forth for consideration in the various countries under review. The Actors of Collective Bargaining will be of great value for all practitioners and academics in the field of industrial relations.

Book Synopsis International labour law reports by : Zvi H. Bar-Niv
Download or read book International labour law reports written by Zvi H. Bar-Niv and published by Martinus Nijhoff Publishers. This book was released on 2000-02-29 with total page 594 pages. Available in PDF, EPUB and Kindle. Book excerpt: The "International Labour Law Reports" is a series of annual publications of labour law judgements by the highest courts in a number of jurisdictions. "ILLR" is intended primarily for the use of judges, labour law practitioners, industrial relations specialists and students who need or desire ready access to authoritative information of a comparative nature on problems arising in the field of labour law and industrial relations. Each judgement reprinted in "ILLR" is accompanied by Headnotes and in practically all cases by an Annotation which sets forth, among other things, the legal issues involved, the basic facts of the case (if not included in the judgement itself), the relevant statutory provisions and judicial precedents, the labour law and industrial relations context in which the case arose and the significance of the judgement in the development of the law. As a rule, judgements are printed "in extenso"; editorial discretion has been relied upon to delete or to summarize portions of judgements that are purely technical or only of marginal interest. This series unquestionably fills a void in the field of comparative labour law. Volume 18 covers the period 1 October 1997 to 30 September 1998.

This book was released on 2015-12-28 with total page 491 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since 2007 and the economic meltdown caused by the financial crisis, our societies have been evolving in different ways. New political movements have emerged in Southern Europe and new social movements in pursuit of common concerns are playing a more active role in our daily lives. In a parallel way, after the failure to predict the financial crisis, economist and social science researchers seek fresh thinking and new models that can better explain this new reality. Regulations are of critical importance in shaping the welfare of economies and society. Thus, core legal disciplines are exploring the effects of the financial crisis on social rights, labour market regulations, and civil, common law or international law, among others. With no doubt, the economic crisis has deeply impacted our economic, social, political and legal environment. During the last decade, researchers from a wide range of disciplines have been looking for solutions. Now it is time make a side stop on the way and to gather results. The 1rst International SBRLab Conference, Finding solutions for a post-crisis society, is organized by the Social and Business Research Lab (SBRLab), Universitat Rovira i Virgili. It is as an international and virtual meeting point of interdisciplinary research and researchers. The purpose of this international conference is to bring together researchers from management, economics, political, social and legal disciplines in order to present and discuss new trends in their respective fields.

Download or read book Labour Law Chile written by Emilio Morgado-Valenzuela and published by Kluwer Law International B.V.. This book was released on 2022-08-20 with total page 480 pages. Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this monograph on Chile not only describes and analyses the legal aspects of labour relations, but also examines labour relations practices and developing trends. It provides a survey of the subject that is both usefully brief and sufficiently detailed to answer most questions likely to arise in any pertinent legal setting. Both individual and collective labour relations are covered in ample detail, with attention to such underlying and pervasive factors as employment contracts, suspension of the contracts, dismissal laws and covenant of non-competition, as well as international private law. The author describes all important details of the law governing hours and wages, benefits, intellectual property implications, trade union activity, employers’ associations, workers’ participation, collective bargaining, industrial disputes, and much more. Building on a clear overview of labour law and labour relations, the book offers practical guidance on which sound preliminary decisions may be based. It will find a ready readership among lawyers representing parties with interests in Chile, and academics and researchers will appreciate its value in the study of comparative trends in laws affecting labour and labour relations.
Book Synopsis Global Trade, Labour Rights and International Law by : Aneta Tyc
Download or read book Global Trade, Labour Rights and International Law written by Aneta Tyc and published by Routledge. This book was released on 2021-06-21 with total page 171 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides a set of proposals for how best to guarantee effective enforcement of labour rights worldwide. The linkage between labour standards and global trade has been recurrent for some 200 years. At a time when the world is struggling to find a way out of crisis and is striving for economic growth, more than ever there is a need for up-to-date research on how to protect and promote labour rights in the global economy. This book explores the history of the field and also provides an overview of emerging trends and opportunities. It discusses the most recent problems including: the effectiveness and the role of the International Labour Organization (ILO) in the second century of its existence, the World Trade Organization (WTO) and its potential relevance in the protection of labour rights, the effectiveness of the US and the EU Generalised System of Preferences, the impact of corporate social responsibility (CSR) instruments on labour rights, and labour provisions in the international trade agreements concluded by the US and the EU. The book argues, inter alia, that trade agreements seem to be a useful tool to help pave the way out of the crisis and that the United States–Mexico–Canada Agreement (USMCA) can be perceived as a model agreement and a symbol of a shift in perspective from long global supply chains to a focus on regional ones, local production, jobs and a rise in wages. The book will be essential reading for academics and students in the fields of human rights law, international labour law, industrial relations law, international sustainable development law, international economic law and international trade law. It will also be of interest to practitioners, non-government organisations (NGOs) and policy makers.
Book Synopsis The International Defense of Workers by : Kevin J. Middlebrook
Download or read book The International Defense of Workers written by Kevin J. Middlebrook and published by Columbia University Press. This book was released on 2024-04-23 with total page 586 pages. Available in PDF, EPUB and Kindle. Book excerpt: International trade agreements have often been criticized for limited attention to the rights of workers. The North American Agreement on Labor Cooperation (NAALC), a side agreement to the North American Free Trade Agreement (NAFTA), stands out for linking labor rights provisions to a U.S. trade agreement. Kevin J. Middlebrook provides a comprehensive and systematic examination of the NAALC, assessing its efficacy in protecting workers’ rights over the entire period it was in effect and demonstrating its broader significance for the role of trade and labor standards in U.S. foreign policy. Placing the NAALC in comparative context, Middlebrook considers various ways of promoting workers’ rights and how other U.S. international trade agreements have influenced labor rights abroad. He investigates the origins of the agreement; the political controversies among Canada, Mexico, and the United States over its scope; how the agreement operated in practice; and its longer-term policy legacies. Middlebrook emphasizes the tension between state sovereignty and the international promotion of labor rights in the negotiation and implementation of trade agreements, as well as how labor movements in one partner country can galvanize action in others. Drawing on interviews with high-level officials involved in the trade negotiations and previously unexamined primary sources, The International Defense of Workers is a groundbreaking analysis of the effects of U.S. trade agreements on labor rights.
