Much of the original document has remained the same since it was first drafted in 1875, yet there have been many innovative developments to the constitution throughout its history. The Nebraska State Constitution is the first modern comprehensive reference to the state's constitution. In it, authors Robert D. Miewald and Peter J. Longo provide a detailed account of Nebraska's political history, and describe in detail debates over major political issues. Previously published by Greenwood, this title has been brought back in to circulation by Oxford University Press with new verve. Re-printed with standardization of content organization in order to facilitate research across the series, this title, as with all titles in the series, is set to join the dynamic revision cycle of The Oxford Commentaries on the State Constitutions of the United States. The Oxford Commentaries on the State Constitutions of the United States is an important series that reflects a renewed international interest in constitutional history and provides expert insight into each of the 50 state constitutions. Each volume in this innovative series contains a historical overview of the state's constitutional development, a section-by-section analysis of its current constitution, and a comprehensive guide to further research. Under the expert editorship of Professor G. Alan Tarr, Director of the Center on State Constitutional Studies at Rutgers University, this series provides essential reference tools for understanding state constitutional law. Books in the series can be purchased individually or as part of a complete set, giving readers unmatched access to these important political documents.

Available in PDF, EPUB and Kindle. Book excerpt: This is the first modern, comprehensive reference on the Nebraska State Constitution. Written in 1875, much of the basic law remains the same, and yet important innovative developments provide for a history of controversy up to the present. The guide consists of a short constitutional history, the text of the constitution, article-by-article with commentary, a selected bibliography, a table of cases, and a full general index. This easy-to-use, one-volume guide for students, scholars, and legal professionals is a valuable acquisition for law, college and university, and school libraries. The Nebraska Constitution is one of the oldest state constitutions in America. It has been amended nearly 200 times, with important changes including a unicameral legislature. The constitutional history recounted in the first part of the volume describes fiery debates over major issues even today--such as personal property tax, clemency, cases the state can take to court, reimbursement of depositors in failed savings and loan companies, to mention just a few. The full text of the constitution and its detailed analysis with new interpretations over the years is presented for easy reference and careful study.

Book Synopsis Forging New Freedoms by : William G. Ross
Download or read book Forging New Freedoms written by William G. Ross and published by U of Nebraska Press. This book was released on 1994-01-01 with total page 304 pages. Available in PDF, EPUB and Kindle. Book excerpt: In several landmark decisions during the mid-1920s, the U.S. Supreme Court significantly expanded the scope of the Constitution's protection of individual freedom by striking down state laws designed to repress or even destroy privateøand parochial schools. Forging New Freedoms explains the origins of na-tivistic hostility toward German and Japanese Americans, Roman Catholics, Lutherans, and other groups whose schools became the object of assaults during and shortly after World War I. The book explores the campaigns to restrict foreign language instruction and to require compulsory public education. It also examines the background of Meyer v. Nebraska and Farrington v. Tokushige, in which the Court invalidated laws that restricted the teaching of foreign languages, and Pierce v. Society of Sisters, which nullified an Oregon law that required all children to attend public elementary schools. Drawing upon diverse sources, including popular periodicals, court briefs, and unpublished manuscripts, William G. Ross explains how the Court's decisions commenced the Court's modern role as a guardian of civil liberties. He also traces the constitutional legacy of those decisions, which have provided the foundation for the controversial right of privacy. Ross's interdisciplinary exploration of the complex interaction among ethnic and religious institutions, nativist groups, public opinion, the legislative process, and judicial decision-making provides fresh insights into both the fragility and the resilience of civil liberties in the United States. While the campaigns to curtail nonpublic education offer a potent reminder of the ever-present dangers of majoritarian tyranny, the refusal of voters and legislators to exact more extreme measures was a tribute to the tolerance of American society. The Court's decisions provided notable examples of how the judiciary can pro-tect embattled minorities who are willing to fight to protect their rights.

Book Synopsis The White Earth Nation by : Gerald Vizenor
Download or read book The White Earth Nation written by Gerald Vizenor and published by University of Nebraska Press. This book was released on 2012-11 with total page 122 pages. Available in PDF, EPUB and Kindle. Book excerpt: The White Earth Nation of Anishinaabeg Natives ratified in 2009 a new constitution, the first indigenous democratic constitution, on a reservation in Minnesota. Many Native constitutions were written by the federal government, and with little knowledge of the people and cultures. The White Earth Nation set out to create a constitution that reflected its own culture. The resulting document provides a clear Native perspective on sovereignty, independent governance, traditional leadership values, and the importance of individual and human rights. This volume includes the text of the Constitution of the White Earth Nation; an introduction by David E. Wilkins, a legal and political scholar who was a special consultant to the White Earth Constitutional Convention; an essay by Gerald Vizenor, the delegate and principal writer of the Constitution of the White Earth Nation; and articles first published in Anishinaabeg Today by Jill Doerfler, who coordinated and participated in the deliberations and ratification of the Constitution. Together these essays and the text of the Constitution provide direct insight into the process of the delegate deliberations, the writing and ratification of this groundbreaking document, and the current constitutional, legal, and political debates about new constitutions.

Book excerpt: Stories of the heartland by the National Book Award finalist and author of The Assassination of Jesse James by the Coward Robert Ford. “Nebraska captures a rowdy, changing America. Written with wit and brawny lyricism, in voices ranging from hip to tender, the stories gathered here are as diverse and expansive as the country they celebrate…References to America’s heartland abound throughout the book and serve as a central metaphor for what’s close to American hearts, what connects us: dreams, myths and possibilities as vast as the Great Plains. Wise and smart-alecky, creaking with legend and crackling with modernisms, these tales are about American obsessions past and present.” –The Washington Post Book World “Just as Raymond Carver came to be identified with a Pacific Northwest populated by blue-collar workers, and just as Richard Ford has crafted a Montana full of drifters, so Ron Hansen has carved out his own geographical niche. His Nebraska is a distinctive mix of 19th century settlers and 1980s breadwinners, of sudden storms and life-long yearnings, of lost souls stranded in the middle of nowhere.” –USA Today “Beautifully crafted stories… Wickedness, evil, malice is called by name; and for Hansen’s people the snake in the garden never fails to appear.” —The New York Times “Breathtaking virtuosity…These short narratives are utterly clean and smooth; they click together like a collection of river-washed stones that are each remarkably different yet polished by the same hand.”—Publishers Weekly
