In addition, this interim final rule requires schools participating in the National School Lunch Program and School Breakfast Program to make potable water available to children at no charge in the place where lunches are served during the meal service, consistent with amendments made by section 203 of the HHFKA, and in the cafeteria during breakfast meal service. This interim final rule is expected to improve the health and well-being of the Nation's children, increase consumption of healthful foods during the school day, and create an environment that reinforces the development of healthy eating habits. Federal cash funding and USDA commodity food support is guaranteed to schools and other providers based on the number of meals or snacks served, who is served (e.g., free meals for poor children get higher subsidies), and legislatively established (and inflation-indexed) per-meal reimbursement (subsidy) rates. In FY2013, federal spending on these programs totaled over $19 billion. The vast majority of the child nutrition programs account is considered mandatory spending, with trace amounts of discretionary funding for certain related activities. The underlying laws covering the child nutrition programs were last reauthorized in 2010 in the Healthy, Hunger-Free Kids Act of 2010 (HHFKA, P.L. 111-296). The legislation made significant changes in child nutrition programs-including increasing federal financing for school lunches, expanding access to community eligibility and direct certification options for schools, and expanding eligibility options for child care homes. The law required an update to school meal nutrition guidelines as well as new guidelines for food served outside the meal programs (e.g., vending machines and cafeteria a la carte lines). USDA updated the nutrition guidelines for school meals, and these changes have been gradually implemented in school meals. For school year 2014-2015, schools are following USDA rules that add nutrition guidelines for the non-meal foods sold in schools. Further information on the 2010 reauthorization's provisions can be found in CRS Report R41354, Child Nutrition and WIC Reauthorization: P.L. 111-296; however, some provisions will be discussed as part of this report's program overview.

These regulations affect State agencies and local program operators that administer the Child Nutrition Programs and households which apply for and/or are approved for free and reduced price meals or free milk. The final rule reflects the disclosure provisions of the Healthy Meals for Healthy Americans Act of 1994 and comments received on the proposed rule published in anticipation of implementing those provisions. Additionally, this final rule includes the regulatory disclosure provisions implementing the Agricultural Risk Protection Act of 2000 and comments received on the interim rule issued to implement those provisions. This final rule also implements nondiscretionary provisions of the Child Nutrition and WIC Reauthorization Act of 2004, allowing certain third party contractors access to children's eligibility status and will allow school officials to communicate with Medicaid and SCHIP officials to verify that children are eligible for free and reduced price school meals or free milk. The disclosure provisions are intended to reduce paperwork for administrators of certain programs that target low-income households and for low-income households which may benefit from those programs by allowing some sharing of household's free and reduced price meal eligibility information. This rule also includes several technical amendments. These changes are based on the Dietary Guidelines for Americans, science-based recommendations made by the National Academy of Medicine (formerly the Institute of Medicine of the National Academies), cost and practical considerations, and stakeholder's input. This is the first major revision of the Child and Adult Care Food Program meal patterns since the Program's inception in 1968. These improvements to the meals served in the Child and Adult Care Food Program are expected to safeguard the health of young children by ensuring healthy eating habits are developed early, and improve the wellness of adult participants.
