Book excerpt: This volume commemorates life and oeuvre of Willi Paul Adams. He belonged to a generation of German historians of the United States who shaped the profession in multifaceted ways. Kathleen Conzen, University of Chicago, writes in her commemorative essay: "Willi Paul Adams produced an impressive and varied body of scholarship in his chosen field of American history. He made a lasting contribution to our understanding of the basic principles and processes under which Americans established their first democratic constitutions, stimulated significant inquiry into the political consequences of immigration for the United States, produced three major interpretive surveys of American history for non-American audiences, and gave German readers access through scholarly translations to major documents in the American political tradition."

Book excerpt: This new approach to the social history of Afrikaner nationalism looks into the diverse causes for the rise of a political movement which was to shape South African history profoundly during the 20th Century. In the 1930s Afrikaner nationalism transformed itself from a populist into a cultural nationalism, becoming politically radicalised at the same time. The nationalist symbol of the oxwagon was used not only by the National Party, but also by the extra- and antiparliamentarian mass movement Ossewabrandwag, which was founded in 1939. Drawing on a broad range of archival resources the social history of this extremist organisation is analysed, showing local and regional differences. The Ossewabrandwag as a nationalist movement counted a considerable part of the Afrikaans white population among its members. Therefore, the Ossewabrandwag can be understood approprately only in the context of radical Afrikaner nationalism. Given that the potential for political radicalisation in the white South African population was considerable, ideological influences from overseas played merely an additional role. The book looks into the reasons for the mass participation in the Ossewabrandwag. In addition it analyses the organisation's fight with the National Party and its illegal and treasonable activities. In this context the book discusses which ideological influences on the apartheid policy can be identified as coming from organised right wing extremism.

Book excerpt: A mood of anger with the political system has been stirring across Canada; yet rather than turning away from the system, many Canadians are actually seeking a greater say in matters that affect them. they want to become more effective participants in the political process. In this timely book, Patrick Boyer examines the important role that direct democracy -- through the occasional use of referendums, plebscites, and inniatives -- can play in concert with our existing institutions of representative democracy. This concept is not alien to our country, says Boyer, pointing to the two national plebiscites (on prohibition of alcohol in 1898 and consciption for overseas military service in 1942), some sixty provincial plebscites (on everything from sovereignty-association to abortion, medicare to women's suffrage, prohibition to ownership of power companies), and several thousand at the municipal level. Direct voting is an important instrument in a truly democratic society, Boyer argues, and it has a more important rold in the current reformation of Canada than some in the comfortable growing governing classes want to admit. In addition to clarifying an issue, it is an educational tool, as the plebiscite campaign becomes a national teach-in. Canadians can become participants, rathe rthan mere spectators, in the major changes and transcending isues that affect the future of our country. The People's Mandate is a helpful guide to understanding the distinctions between plebiscites and referendums in a purely Canadian context. It addresses some of the concerns about this unparliamentary practice, and makes a powerful and logical statement about democracy. In sum, Boyer believes it is essential to govern with the trust of the people.

Book excerpt: The Hill Times: Best Books of 2017 What happens when crucial public issues are decided the people themselves? Canadians answered “Yes” or “No” to prohibiting alcohol, conscripting soldiers, and revamping our constitution. Forcing such crucial choices at the ballot box is high-stakes democracy, both here and overseas — as witnessed with Britain’s transformative 2016 “Brexit” referendum. Forcing Choice dissects Canada’s extensive use of ballot questions at all levels of government, and weighs the benefits of citizens making fundamental decisions for the nation. Holding referendums is tricky, and getting it wrong carries a high price. This hard-hitting book draws on Boyer’s deep research on direct democracy and his experience advising governments about referendums, writing books, drafting and introducing the Canada Referendum Act, monitoring foreign referendums, and campaigning in Canadian ones.

Available in PDF, EPUB and Kindle. Book excerpt: The third in a series of three volumes on Contemporary Legal Theory, this volume deals with four topics: 1) the role of legal theory in the legal curriculum; 2) the teaching of legal theory; 3) the relationship of legal theory to legal scholarship; and 4) the relationship of legal theory to comparative law. The focus of the first two topics is on the common law world, where the debates over the aims and proper place of legal theory in the study of law have traversed a good deal of ground since John Austin's 1828 lecture, 'The Uses and the Study of Jurisprudence.' These first two parts offer a selection of the most important papers, including surveys, as well as pedagogical viewpoints and particular course descriptions from analytical, critical, feminist, law-and-literature and global perspectives. The last three decades have seen just as many changes for legal scholarship and comparative law. These changes (such as the rise of empirical legal scholarship) have often attracted the attention of legal theorists. Within comparative law, the last thirty years have witnessed intense methodological reflection within the discipline; the results of these reflections are themselves properly recognised as legal theoretical contributions. The volume collects the key papers, including those by Neil MacCormick, Mark Van Hoecke, Andrew Halpin, William Ewald and Geoffrey Samuel.
