It provides a clear link to voluntariness as the foundation of contractual liability and compares the English position, in light of this theory, with the Principles of International Commercial Contracts (PICC), the Principles of European Contract Law (PECL), the Draft Common Frame of Reference (DCFR) and the US Restatement (Second) of Contracts.

Available in PDF, EPUB and Kindle. Book excerpt: "Challenging Misrepresentations of Black Womanhood" investigates the typecasting of Black womanhood and the larger sociological impact on Black women’s self-perceptions. It details the historical and contemporary use of stereotypes against Black women and how these women work to challenge and dispel false perceptions. The book highlights the role of racist ideas in the reproduction and promotion of stereotypes of Black femaleness in media, literature, artificial intelligence and the perceptions of the general public. Contributors in this collection identify the racist and sexist ideologies behind the misperceptions of Black womanhood and illuminate twenty-first–century stereotypical treatment of Black women such as Michelle Obama and Serena Williams, and explore topics such as comedic expressions of Black motherhood, representations of Black women in television dramas and literature, and identity reclamation and self-determination. "Challenging Misrepresentations of Black Womanhood" establishes the criteria with which to examine the role of stereotypes in the lives of Black women and, more specifically, its impact on their social and psychological well-being.

Available in PDF, EPUB and Kindle. Book excerpt: How can a promise be a lie? Answer: when the promisor never intended to perform the promise. Such incidences of promissory fraud are frequently litigated because they can result in punitive damages awards. And an insincere promisor can even be held criminally liable. Yet courts have provided little guidance about what the scope of liability should be or what proof should be required. This book—the first ever devoted to the analysis of promissory fraud—answers these questions. Filled with examples of insincere promising from the case law as well as from literature and popular culture, the book is an indispensable guide for those who practice or teach contract law. The authors explore what promises say from the perspectives of philosophy, economics, and the law. They identify four chief mistakes that courts make in promissory fraud cases. And they offer a theory for how courts and practitioners should handle promissory fraud cases.

Book excerpt: Each side, and those ostensibly of no side, discerned a culture of passion, slander, libel, lies, hypocrisy, dissimulation, conspiracy, private languages, and fictions. 'Truth' appeared an ambiguous, political matter. Yet the reaction to partisanship was also creative, for it helped to construct an ideal form of political discourse. This was one based on reason rather than passion, on moderation rather than partisan zeal, on critical reading rather than credulity; and an increasing realization that these virtues arose from infrequent rather than frequent elections. Finding synergies between social, political, religious, scientific, literary, cultural, and intellectual history, "Representation and Misrepresentation in Later Stuart Britain" reinvigorates the debate about the emergence of 'the public sphere' in the later Stuart period

Available in PDF, EPUB and Kindle. Book excerpt: In this original and illuminating new study, Mark Knights reveals how the political culture of the eighteenth century grew out of earlier trends and innovations. Arguing that the period from 1675 needs to be seen as the second stage of a seventeenth-century revolution that ran on until c.1720, Representation and Misrepresentation in Later Stuart Britain charts the growth of a national political culture and traces the development of the public as an arbiter of politics. In doing so, it uncovers a crisis of public discourse and credibility, and finds a political enlightenment rooted in local and national partisan conflict. The later Stuart period was characterized by frequent elections, the lapse of pre-publication licensing, the emergence of party politics, the creation of a public debt, and ideological conflict over popular sovereignty. These factors combined to enhance the status of the 'public', not least in requiring it to make numerous acts of judgement. Contemporaries from across the political spectrum feared that the public might be misled by the misrepresentations pedalled by their rivals. Each side, and those ostensibly of no side, discerned a culture of passion, slander, libel, lies, hypocrisy, dissimulation, conspiracy, private languages, and fictions. Finding synergies between social, political, religious, scientific, literary, cultural, and intellectual history, Representation and Misrepresentation in Later Stuart Britain reinvigorates the debate about the emergence of 'the public sphere' in the later Stuart period.
