Book excerpt: This book challenges the traditional view that meaningful analogies cannot be drawn between domestic and international politics. Alexandru V. Grigorescu shows that there are important parallels to be drawn across these two realms, if political interactions among states over the past two centuries are compared to those within states going back about a thousand years. He focuses specifically on the evolution of institutions that restrain concentrated power, such as courts, assemblies, and bureaucracies. Restraining Power through Institutions begins by developing a set of theoretical arguments about the emergence, change, and consolidation of institutional restraints on power. These are primarily derived from literature focusing on domestic politics going back to events such as those surrounding the signing of the Magna Carta and the emergence and evolution of the Curia Regis in England, or of the Estates General and Parlements in France. It then assesses the relevance of such arguments for the evolution of numerous international institutions: international courts, such as the Permanent Court of Arbitration, International Court of Justice, and International Criminal Court; international assemblies and parliaments, such as the Assembly of the League of Nations, UN General Assembly; and European Parliament; and international secretariats, such as those of the Central Commission for the Navigation of the Rhine, League of Nations, UN, and World Bank. The similarities between developments in the domestic and international realms lead to a number of important conclusions about future expectations for international institutions and for world politics more broadly. In particular, the book argues that complementing the traditional focus on efforts to acquire power with the "Lockean" focus on restraining power offers a more complete depiction of international politics. This novel perspective consequently shifts the focus from the interests and actions of a handful of powerful states to those of virtually all states and groups of states, regardless of how powerful they are.

The propensity of parliamentarians to ask questions indicates that the interrogatories are an important tool for measuring an individual legislator’s job. Ultimately, how a parliamentarian chooses to use the questioning tool provides a unique insight into legislator behaviour and role orientation. Many of the chapters in this volume provide new empirical measures of legislator activity and use this data to provide new tests of leading theories of legislator behaviour. At an institutional level, questions provide an important source of information for the chamber and are a critical tool of government oversight – as many of the chapters in the volume indicate. Evidence of the impact of questions on executive and bureaucratic oversight challenges conventional views of parliaments as weak and ineffective parts of the political process. Book excerpt: The Secure Training Centre (Amendment) Rules (SI 2007/1709, ISBN 9780110773742) which amended the Secure Taining Centre Rules 1998 (SI 1998/472, ISBN 9780110656083) came into force in July 2007 without Parliamentary debate. They amend the existing Rules to permit Secure Training Centres (STCs) to use force against detained children and young people to "ensure good order and discipline". The Amendment Rules were criticised and the Government promised a review. A judicial review of the Amendment Rules by the High Court, held that they represented a "significant change in policy" The Joint Committee on Human Rights considers in this report their compatibility with the UK's human rights obligations. Restraint allowed in STCs is known as Physical Control in Care (PCC) and comprises a range of restraint holds and so called "distraction techniques" The Minister of Justice, for the Department of Justice, states the Government does not sanction violence against children, but the Committee considers that this is the effect of current UK law. In the Committee's view the Amendment Rules have created more confusion and have widened the scope for the use of force in an unacceptable manner. It recommends new Amendment Rules to make clear that physical restraint is not permissable for the purposes of good order and discipline and recommends careful monitoring of the effect of the Amendment Rules with regular reports by Government to Parliament on the number of restraint incidents. The Committee does welcome the creation of the Youth Justice Unit along with the re-establishment of the Medical Review Panel and also welcomes the Government's suspension of two restaint techniques in December 2007. The Committee further recommends the abolition of all distraction techniques and suggests a series of measures to ensure compliance by STCs with human rights standards as well as the publication of the PCC training manual in full and disseminated to all staff who use restraint.

In Power and Restraint in China’s Rise, Chin-Hao Huang argues that a rising power’s aspirations for acceptance provide a key rationale for refraining from coercive measures. He analyzes Chinese foreign policy conduct in the South China Sea, showing how complying with regional norms and accepting constraints improves external perceptions of China and advances other states’ recognition of China as a legitimate power.
