La Parte I está dedicada al estudio de la «creatividad computacional» y a la aplicación de la «realidad aumentada» en el mundo del arte. Respecto de la primera, se analizan cuestiones como la «originalidad», cuando el «autor» es un sistema de inteligencia artificial, viendo quién debe ser el titular de las facultades de explotación económica de la «obra» de este modo «producida» o «creada». En este punto, son sugerentes las aportaciones de la Dra. Susana Navas (catedrática de Derecho civil) y de la Dra. Marina Castells (investigadora postdoc) en torno a la cocreación humano-robot. En relación con el segundo ámbito mencionado —realidad aumentada y arte— nos enfrentamos a su configuración como «obra multimedia», asunto estudiado por la Profesora Navas. En la Parte II se analiza la «protección del derecho de autor», abordándose el aspecto concerniente a las medidas tecnológicas de protección y a la automatización de la cesión de facultades de explotación económica mediante la tecnología blockchain, Ethereum y otras más avanzadas. De la pluma del Prof. Carlos Górriz (titular de Derecho mercantil) se presenta el primer extremo, con especial atención a las normas y documentos europeos en la materia. De la del Dr. Santiago Robert (profesor asociado de Derecho civil) es la contribución acerca de la cesión de facultades de explotación mediante los denominados smart legal contracts, sobre la base de ya referida tecnología. En la última parte, la Parte III, se exponen aplicaciones tecnológicas concretas que afectan a los derechos de los autores. Cuatro son los temas tratados. El primero se refiere al Big Data y su relación con las nuevas desestructuradas bases de datos como acicate para reformular el derecho sui generis del fabricante. En este interesante aspecto se entretiene Ramon Romeu (profesor asociado de Derecho civil). El segundo tema objeto de interés, de la mano de la Prof. Sandra Camacho (profesora agregada de Derecho civil), es la biblioteca digital, contribución en la que la autora hace aplicación del principio de equivalencia funcional entre la biblioteca física o analógica y la digital-virtual. Seguidamente, el tercer foco —contribución escrita por Cristina Alonso (profesora asociada de Derecho civil)— es el libro electrónico, donde se reflexiona acerca del concepto mismo de libro. El último tema tratado son los contenidos de acceso abierto, como manifestación de una «ciencia abierta a todos», que escribe Iván Mateo (profesor asociado de Derecho civil).

Book excerpt: Los datos se han convertido en un nuevo activo intangible de gran valor para los organismos privados y públicos a partir de los cuales pueden mejorar u ofrecer nuevos productos, servicios y procesos. Es lo que se denomina la innovación basada en los datos. Este incremento de valor de los datos provoca que su protección se haya convertido en una cuestión fundamental. La labor del profesional del Derecho para asesorar a estos organismos en este sentido no es fácil. Dejando aparte la necesaria adopción de medidas tecnológicas de protección, el carácter digital de los datos implica que las figuras jurídicas más adaptadas para su protección jurídica sean los derechos de propiedad intelectual. Pero, ¿a qué figura en particular debe acudirse: secretos comerciales, derechos de autor, derecho sui generis sobre las bases de datos, soluciones contractuales, la normativa sobre competencia desleal? Además, no es sólo la protección lo que debe preocupar a estos organismos y a sus asesores jurídicos. La eficiencia de las técnicas de análisis de datos o el desarrollo de sistemas de inteligencia artificial depende, en gran medida del acceso a grandes cantidades de datos. En este sentido, el acceso a datos externos deviene primordial, especialmente en la Unión Europea, donde sus instituciones insisten en que, una de las razones por las que nuestras empresas están en desventaja respecto de sus competidores extranjeros, es la escasa disponibilidad de datos. Se necesitan, por lo tanto, medidas que fomenten el acceso a los datos, para crear lo que la Comisión Europea llama los espacios europeos comunes de datos. Estas medidas incluyen, por ejemplo, la obligación de publicar en abierto la información del sector público, la promoción de la ciencia abierta, o el establecimiento de una excepción de minería de textos y datos. La adopción de estas medidas va a conllevar, necesariamente, una flexibilización del sistema de propiedad intelectual europeo. No obstante, dicha flexibilización no puede ser de tal calado que se desincentive la inversión en la producción de información y contenidos. Para alcanzar una adecuada ponderación de los intereses en presencia, en esta obra se aboga por la adopción del principio “tan abiertos como sea posible, tan cerrados como sea necesario” como criterio general rector a la hora de configurar estas nuevas medidas.Aurelio Lopez-Tarruella Martínez es Profesor Titular de Derecho internacional privado en la Universidad de Alicante, director del grupo de investigación Global Innovation Law & Policy, GIP Law (UA), y director de la Cátedra iberoamericana de Cultura Digital y Propiedad Intelectual. Es autor de gran numero de publicaciones en materia de derechos de propiedad intelectual, tecnologías digitales y Derecho internacional privado, profesor en el Master de Derecho de la Sociedad Digital de la Universidad de Alicante y de otros masters y cursos de posgrado en España y el extranjero. Pero lo que resulta más difícil conseguir es el punto adecuado para el nuevo equilibrio entre los intereses en juego, especialmente por el peso económico que adquiere en el nuevo contexto la información y los contenidos de las obras de todo tipo. Probablemente uno de los aspectos más significativos a la hora de fijar los nuevos equilibrios son precisamente los límites e infracciones a la explotación en exclusiva de los derechos reconocidos al titular sobre las obras, así como las infracciones a tales derechos creadas por el legislador. Límites e infracciones que marcan la amplitud de capacidades otorgadas por el ordenamiento jurídico, combinando las legítimas expectativas del creador y el indudable interés general en el acceso a obras de cultura y conocimiento por los miembros de una sociedad. Entre las infracciones a los derechos de autor que el legislador interpone para su defensa destacan las de carácter penal por sus consecuencias de todo tipo para el autor del hecho ilícito.
