Available in PDF, EPUB and Kindle. Book excerpt: This book challenges the dominant intellectual assumptions of mainstream international law scholarship regarding the principle of Sovereign Equality. The animus and scope of this challenge is situated in the context of the decision-making processes in International Governmental Organizations (IGOs) which employ the `one state, one vote' and/or the `weighted voting' rule. Using the theories of Functionalism and Legitimacy to analyze the legal implications and complications of the principal voting mechanisms and voting practices of certain key IGOs vis-à-vis the doctrine of Sovereign Equality, the author establishes that this doctrine has remained far too orthodox for contemporary realities. In this context, she emphasizes the importance of the necessity for functional legitimate decision-making processes in global governance, and, accordingly, advocates the elimination of the anachronistic and non-viable principle of Sovereign Equality from international institutional law. The author also rejects the introduction of any new principle in IGOs - e.g. democratic governance - which will render decision-making even less functional.

Book excerpt: Annotation Breach of contract is a hot topic in risk management, especially in the context of Public-Private Partnerships for large utility, infrastructure, or mineral resource exploitation projects around the world. Some claims are related to economic crisis, but more often disputes arise from political change, privatization reviews, environmental regulations and governance/corruption issues. Some recent high profile cases involving government tariff renegotiations and award settlements underline the importance of this topic for international investors. Claims of breach of contract often bring about an abrupt termination of activities or force contract renegotiations that subtsantially alter the original terms of the deal and projected financial validity. This study offers significant new data and analysis to allow an informed assessement of current developments and underlying trends, in a new collaboration between the World Bank Group (IBRD, MIGA, and ICSID) and Washington University in St. Louis.

Book excerpt: The second edition of this Handbook contains more than 30 new and original articles as well six essential updates by leading scholars of global environmental politics. This landmark book maps the latest theoretical and empirical research in this energetic and growing field. Captured here are the pioneering and lively debates over concerns for the health of the planet and how they might best be addressed. The introduction explores the intellectual trends and evolving parameters in the field of global environmental politics. It makes a case for an expansive definition of the field, one that embraces an interdisciplinary literature on the connections between global politics and environmental change. The remaining chapters are divided into four broad themes – states and cooperation; global governance; the political economy of governance; and knowledge and ethics – with each section covering key emerging issues. In-depth explorations are given to topics such as climate change, multinational corporations, international agreements and UN organizations, regulations and business standards, trade and international finance, multilevel and transnational governance, and ecological citizenship. Handbook of Global Environmental Politics, Second Edition is a comprehensive review of the field and offers cutting-edge ideas for further research. As such, scholars, students and policymakers will find themselves looking to it for many years to come.

Book excerpt: Fighting the obesity epidemic has so far proven a difficult challenge, given the diversity of natural and processed foods, the complexity of food supply chains, and the fact that targeting excessive caloric consumption is far trickier than reducing overall consumption (as for tobacco). Nevertheless, efforts to curb caloric intake are gearing up and the experience from tobacco control has drawn much attention on a potential role for excise taxes in fighting obesity. Many related questions have therefore been raised as part of the IMF's capacity development work: Should excises on unhealthy food be used to fight obesity? If so, under what conditions? What are the product and market characteristics that would help identify the relevant tax bases and the rates at which to tax them? While acknowledging that the scientific evidence keeps evolving, this note summarizes the ongoing debate and practice on food excises and on their potential role as a policy tool to fight the obesity epidemic, with a view to assist policymakers in deciding whether to go forward, and if so, how.How to Apply Excise Taxes to Fight Obesity

Book excerpt: Are foreign investors the privileged citizens of a new constitutional order that guarantees rates of return on investment interests? Schneiderman explores the linkages between a new investment rules regime and state constitutions – between a constitution-like regime for the protection of foreign investment and the constitutional projects of national states. The investment rules regime, as in classical accounts of constitutionalism, considers democratically authorized state action as inherently suspect. Despite the myriad purposes served by constitutionalism, the investment rules regime aims solely to enforce limits, both inside and outside of national constitutional systems, beyond which citizen-driven politics will be disabled. Drawing on contemporary and historical case studies, the author argues that any transnational regime should encourage innovation, experimentation, and the capacity to imagine alternative futures for managing the relationship between politics and markets. These objectives have been best accomplished via democratic institutions operating at national, sub-national, and local levels.

Book excerpt: As the postwar international system continues its dramatic transformation, the fundamental question of what role China will play is becoming increasingly central. Contributors to the volume focus on the developments of the post-Tiananmen years, addressing the issues raised by China's expanding and increasingly complex relationships with a rapidly changing global environment. They consider such questions as: What is the principal challenge of post-Tiananmen foreign policy? How will China cope with the call for a more peaceful, equitable, democratic, and ecological world order? How has the nexus between China and the world changed in this transition period, and why? What are the implications for China's future and for the future of the rest of the world?Combining a broad theoretical framework with specific case studies, this text tackles themes that have long puzzled Westerners. Seeking the often elusive sources of Chinese foreign policy, the contributors assess the relative influences of domestic and foreign factors in shaping policy goals. They also examine the changes and continuities that have characterized Chinese foreign relations over the years, identifying the patterns underlying China's interactions with the major global actors and its policies on specific international issues. Special attention is paid to the word/deed (and at times word/word) disjuncture in Chinese foreign relations, with several chapters probing the discrepancies between rhetoric and reality, policy pronouncements and policy performance, and intent and outcome. The human-rights component of China's foreign policy and China's foreign policy options for the last decade of the century are also discussed.New to this revised and updated edition of China and the World are discussions concerning Chinese foreign policies and international relations theories, the relationship between China and the Third World, and China's environmental diplomacy.
