Despite their rule by outsiders- Ottoman Turks and, from 1917, the British - Palestinian Arabs had always remained the majority population within Palestine. From the late 19th century increasing numbers of Zionist settlers came, driven by savage pogroms in Eastern Europe and later by the Nazi Holocaust. Control over oil production and marketing have led to the strengthening of governmental role as owner and distributor of oil income. The regions tribal society is being transformed into a modern society. Political modernization is a recent phenomenon if the nature and extent of structural and informal transformations are taken into account. Three broadly defined phases of political change can be discerned in the Arabian Peninsula: the traditional, the neo-traditional, and the modernizing or post-traditional. The modernizing phase was initiated by radical policies of socio-economic development, including the necessary restructuring of replacement of regimes and a redefinition or expansion of the scope and role of the state. However, the pace and direction of change is not clear enough. The coming few decades are crucial in this regard.

During that time the Court has been transformed from a Western (Eurocentric) tribunal in terms both of its judges & also the disputes it was called on to resolve, to an institution broadly representative of the layered, pluralistic world community of today. This is reflected in the fiercely contested battles for election to the Court or the regular triennial elections, & also in the angry denunciations of the Court as a 'political' tribunal rendering 'political' decisions, launched by some national foreign Ministry spokesmen in reaction to Court judgments involving their own states or what they consider as their own vital interests. Within the Court's ranks in recent years there has been a marked philosophical division between those judges (usually from Western or Western-influenced states) who have sought to maintain traditional positivist, strict construction ('neutral') approaches, & those who would in American legal Realist-style, essay a more frankly critical, liberal activist role in the up-dating or re-making of old legal doctrines inherited from earlier eras in international relations. US ).
