Book excerpt: Over the last decade, the issue of reparation for victims of gross and systematic human rights violations has given rise to intense debates at the national and the international level. Discussions particularly arise in post-conflict situations characterised by serious violations of human rights, such as genocide, crimes against humanity, war crimes, and other forms of injustice of the past. Crucial questions include: what harm inflicted to victims warrants reparation? when and how to repair the harm? who is eligible for reparation and who has the duty to repair? These and other questions raise many challenging issues for theory and practice. This volume contains the contributions presented at an international conference in Brussels, in February 2005, on the right to reparation for victims of serious human rights violations. It also includes the final report of a research project undertaken jointly at the Universities of Antwerp (UA) and Leuven (K.U.Leuven) between 2000 and 2004 on the right to reparation in international law for victims of gross and systematic human rights violations, both from a legal and a socio-political perspective. The present volume is aimed at academics, policy-makers, national and international courts and tribunals, the legal professions, and civil society at large.

Book excerpt: This edited volume brings together well-established and emerging scholars of transitional justice to discuss the persistence of amnesty in the age of human rights accountability. The volume attempts to reframe debates, moving beyond the limited approaches of 'truth versus justice' or 'stability versus accountability' in which many of these issues have been cast in the existing scholarship. The theoretical and empirical contributions in this book offer new ways of understanding and tackling the enduring persistence of amnesty in the age of accountability. In addition to cross-national studies, the volume encompasses eleven country cases of amnesty for past human rights violations: Argentina, Brazil, Cambodia, El Salvador, Guatemala, Indonesia, Rwanda, South Africa, Spain, Uganda and Uruguay. The volume goes beyond merely describing these case studies, but also considers what we learn from them in terms of overcoming impunity and promoting accountability to contribute to improvements in human rights and democracy.

Available in PDF, EPUB and Kindle. Book excerpt: This is the first focused study on the relationship between the use of national courts to pursue retrospective justice and the construction of viable democracies. Included in this interdisciplinary volume are fascinating, detailed essays on the experiences of eight countries: Argentina, Bolivia, Chile, Germany, Greece, Hungary, Poland, and South Africa. According to the contributors, the most important lesson for leaders of new democracies, who are wrestling with the human rights abuses of past dictatorships, is that they have many options. Democratizing regimes are well-advised to be attentive to the significant political, ethical, and legal constraints that may limit their ability to achieve retribution for past wrongs. On prudential ground alone, some fledgling regimes will have no choice but to restrain their desire for punishment in the interest of political survival. However, it would be incorrect to think that all new democracies are therefore bereft of the political and legal resources needed to bring the perpetrators of egregious human rights violations to justice. In many instances, governments have overcome the obstacles before them and, by appealing to both national and international legal standards, have brought their former dictators to trial. When these judicial proceedings have been properly conducted and insulated from partisan political pressures, they have provided tangible evidence of the guiding principles-equality, fairness, and the rule of law-that are essential to the post-authoritarian order. This collection shows that the quest for transitional justice has amounted to something more than merely a break with the past--it constitutes a formative act which directly affects the quality and credibility of democratic institutions.

Available in PDF, EPUB and Kindle. Book excerpt: More coin hoards have been recorded from Roman Britain than from any other province of the Empire. This comprehensive and lavishly illustrated volume provides a survey of over 3260 hoards of Iron Age and Roman coins found in England and Wales with a detailed analysis and discussion. Theories of hoarding and deposition and examined, national and regional patterns in the landscape settings of coin hoards presented, together with an analysis of those hoards whose findspots were surveyed and of those hoards found in archaeological excavations. It also includes an unprecedented examination of the containers in which coin hoards were buried and the objects found with them. The patterns of hoarding in Britain from the late 2nd century BC to the 5th century AD are discussed. The volume also provides a survey of Britain in the 3rd century AD, as a peak of over 700 hoards are known from the period from AD 253–296. This has been a particular focus of the project which has been a collaborative research venture between the University of Leicester and the British Museum funded by the AHRC. The aim has been to understand the reasons behind the burial and non-recovery of these finds. A comprehensive online database (https://finds.org.uk/database) underpins the project, which also undertook a comprehensive GIS analysis of all the hoards and field surveys of a sample of them.

Available in PDF, EPUB and Kindle. Book excerpt: The Portable Antiquities Scheme (PAS) is a project run by the British Museum which encourages the voluntary reporting of archaeological artefacts discovered by members of the public in England and Wales, particularly metal detector users. Finds are recorded onto a database (available at www.finds.org.uk), and this resource now holds records for over 800,000 archaeological objects, a figure which increases on a daily basis. Since its establishment in 1997, it has become a key resource for archaeological researchers. Around 40 per cent of the artefacts recorded on the database are of Roman date, and the principal aim of this book is to assess the contribution that this resource can make to our understanding of Roman Britain. Bringing together vast quantities of seemingly random finds scattered across the English and Welsh countryside, Tom Brindle brings order to this data by showing how it can be used to indicate the presence of 240 previously unknown Roman sites. These sites are presented within a series of regional case studies which discuss important new sites as well as statistics that contribute significantly to the understanding of the density of settlement in rural Roman Britain.

This book was released on 2014-10-08T00:00:00-04:00 with total page 314 pages. Available in PDF, EPUB and Kindle.

Available in PDF, EPUB and Kindle. Book excerpt: Rebuilding societies where conflict has occurred is rarely a simple process. Where conflict has been accompanied by gross and systematic violations of human rights, the procedure becomes very controversial. The traditional debate on "transitional justice" sought to balance justice, truth, accountability, peace, and stability. The appearance of impunity for past crimes undermines confidence in new democratic structures and casts doubt upon commitments to human rights. Yet the need to consolidate peace sometimes resulted in reluctance on the part of authorities --both local and international --to confront suspected perpetrators of human rights violations, especially when they are a part of a peace process. Experience in many regions of the world therefore suggested a tradeoff between peace and justice. But that is changing. There is a growing consensus that some forms of justice and accountability are integral to --rather than in tension with --peace and stability. This volume considers whether we are truly going beyond the transitional justice debate. It brings together eminent scholars and practitioners with direct experience in some of the most challenging cases of international justice, and illustrates that justice and accountability remain complex, but not mutually exclusive, ideals.
