Mediation has brought about agreements that halted the fighting in Slovenia, Croatia and Bosnia. Yet, the negotiations took too long, and their achievements came too late. Between 1991 and 1995 some two hundred thousand people lost their lives, and close to two million were uprooted from their homes. Saadia Touval examines why the efforts to reach a negotiated solution have not been more effective. He calls attention to two lessons: that collective mediation faces much greater obstacles than mediation by individual states, and that a mediator's priority should be saving lives, rather than aiming at other objectives, or even pursuing justice.

Book excerpt: This book provides a critical examination of NATO’s evolving strategic and operational roles in the Western Balkans since the disintegration of Yugoslavia in 1991, with a particular focus on Bosnia, Kosovo and the former Yugoslav Republic of Macedonia, in both the conflict and post-conflict phases. While there is a myriad of literature available on the various conflicts that engulfed the former Yugoslavia after the collapse of communism, less has been written on NATO’s overall role in these conflicts. This text, therefore, fills the gap, offering a thematic study of NATO’s roles and duties in this region from the early 1990s to the present day. The ‘levels of analysis’ introduced by Mulchinock provide a new framework for examining NATO’s response to the Yugoslav wars of secession, focusing on the role of key NATO member states and the role of different NATO Secretaries-General, along with the impact of inter-institutional cooperation (and conflict) with other international organisations.

Book excerpt: Mediation has become a common technique for terminating violent conflicts both within and between states; while mediation has a strong record in reducing hostilities, it is not without its own problems. In The Mediation Dilemma, Kyle Beardsley highlights its long-term limitations. The result of this oft-superficial approach to peacemaking, immediate and reassuring as it may be, is often a fragile peace. With the intervention of a third-party mediator, warring parties may formally agree to concessions that are insupportable in the long term and soon enough find themselves at odds again. Beardsley examines his argument empirically using two data sets and traces it through several historical cases: Henry Kissinger's and Jimmy Carter's initiatives in the Middle East, 1973–1979; Theodore Roosevelt's 1905 mediation in the Russo-Japanese War; and Carter’s attempt to mediate in the 1994 North Korean nuclear crisis. He also draws upon the lessons of the 1993 Arusha Accords, the 1993 Oslo Accords, Haiti in 1994, the 2002 Ceasefire Agreement in Sri Lanka, and the 2005 Memorandum of Understanding in Aceh. Beardsley concludes that a reliance on mediation risks a greater chance of conflict relapse in the future, whereas the rejection of mediation risks ongoing bloodshed as war continues. The trade-off between mediation’s short-term and long-term effects is stark when the third-party mediator adopts heavy-handed forms of leverage, and, Beardsley finds, multiple mediators and intergovernmental organizations also do relatively poorly in securing long-term peace. He finds that mediation has the greatest opportunity to foster both short-term and long-term peace when a single third party mediates among belligerents that can afford to wait for a self-enforcing arrangement to be reached.

Contemporary scholarship stresses that the crucial ingredients for a successful multiparty mediation are ‘consistency in interests’ and ‘cooperation and coordination’ between mediators. This book seeks to supplement that understanding by investigating how much the ‘consistency of interests’ and ‘cooperation and coordination’ affect the overall process, and what happens to the mediation process when mediating parties do not share the same idea and interest in finding a common solution. At the same time, it explores the obstacles in achieving coordination and coherence between various mediators in such an environment and how to surmount the problems that multiple mediators face when operating without a ‘common script’ in attempting to mediate a negotiated settlement. The study investigates three distinct mechanisms (both on the systemic and contextual level) that have the potential to deter defection from a (potential) member of the multiparty mediation coalition: geo-political shifts, changes in the conflict dynamics, and mediators’ ability to bargain for a cooperative relationship. As the number of states and international actors that are involved in mediation increases, a careful assessment is necessary not only of their relative institutional strengths and weaknesses, but also of how to promote complementary efforts and how to synchronize the whole process when one actor is transferring the responsibilities for mediation to others.
