Available in PDF, EPUB and Kindle. Book excerpt: The importance of marine and maritime policy can hardly be overstated in view of the fact that over 90% of world trade is sea-borne and the economic interests of developed, developing and emerging economies alike are all heavily dependent on international trade and commerce. What is perhaps not so readily appreciated by the world community at large including the captains of relevant industries such as shipping, fisheries, cargo and insurance interests, is that environmental issues and concerns are at the very heart of commercial growth and development. This is where the "marine" as distinguished from the "maritime" interests fit into the equation. Both are intimately inter-connected and co-related to the extent that policy development in the field cannot be achieved in a rational manner without the consideration of both these essential factors. This book attempts to bring together both these perspectives through the writings and contributions of several distinguished scholars in their respective fields of expertise. The editor is hopeful that the contributions of these individuals will serve to enhance knowledge and interest in marine and maritime policy development and formulation among those involved in this highly specialised area of endeavour, be they government administrators, private sector executives and managers, practitioners, researchers or scholars of related persuasions. The term "policy" in this book carries a broad connotation referring to both policy that is primarily law based as well as policy formulated on economic and sociological considerations. Marine and maritime business, as a significant commercial activity in the world's economy, is heavily regulated by law. In many areas of marine and maritime affairs, the nexus between legal policy and the policy influenced by market forces as well as their mutual interaction is highly significant, especially viewed from a historical perspective.

Available in PDF, EPUB and Kindle. Book excerpt: The first single-volume reference of its kind, this comprehensive handbook provides background information and analysis on the full range of contemporary ocean use issues. Coverage includes the development of ocean law, the evolving uses of oceans, data on living and non-living ocean resources, the environmental impact of pollution, and competing national claims over ocean exploration. The volume also summarizes the most current research available on the uses of oceans, incorporates the salient portions of the 1982 Law of the Sea Convention in the topical surveys and analyses presented, and discusses all of the other major international conventions that have dealt with global ocean or marine affairs. Students, researchers, and agency staff concerned with the political and legal dimensions of ocean use will find this an indispensable source. The handbook begins with an overview of the world's oceans and their physical and geographic features. The next two chapters survey the international conferences that have been held on ocean use and explore the historical development of international principles on the law of the sea. Ocean resources and their economic and political management form the focus of the following four chapters, with separate chapters on living and non-living resources and deep seabed mining. The final chapters address ocean environmental protection and pollution prevention and the implications of various uses of the ocean: military, navigation and transport, and marine scientific research. The text is accompanied by numerous charts and tables, end-of-chapter references, and seven appendixes which contain valuable supplemental information such as a chronological list of conventions and treaties on the law of the sea, national legislation on exclusive economic zones, bilateral fishery agreements, and more.

Available in PDF, EPUB and Kindle. Book excerpt: Stakeholders in the international taxation community agree that existing dispute resolution processes are in serious need of improvement, and a global consensus must be achieved. This book offers a potential restructuring of the tax treaty dispute resolution system based on a comparative analysis of the dispute resolution mechanisms under tax treaties, as prescribed in the OECD and UN models, on the one hand, and the UN Law of the Sea Convention (LOSC) on the other. This comparative study is the first of its kind and is premised on certain key geopolitical similarities that underpin the international tax regime (ITR) and the law of the sea regime while taking into consideration the differences in the institutional context of both regimes. The author proposes a new tax treaty dispute resolution system based on the LOSC system for resolving multilateral tax disputes, focusing on the following: mapping of the institutional arrangements that make up the dispute resolution mechanisms to understand how each system works; comparative analysis of the patterns of interaction and outcomes generated across the two dispute resolution systems to identify relevant aspects of the LOSC system that may be adapted in the ITR to improve tax treaty dispute resolution; and analysis of the inclusivity levels across the decision-making structures under each system to identify specific consensus-building techniques that may facilitate the implementation of the new proposed tax treaty dispute resolution system and also enhance international cooperation across the ITR. The proposed restructuring of the tax treaty dispute resolution system expands the existing mutual agreement procedure and forms a comprehensive legal framework that aims to achieve a more effective, predictable and equitable resolution of multilateral tax disputes in the 21st-century ITR by striking a balance between countries’ right to tax sovereignty and the rule of law. Just as the design of the dispute resolution system under the LOSC paved the way for universal consensus of the Convention among almost 160 countries, the author’s new tax treaty dispute resolution system also offers a solid foundation for consensus-building towards a universal treaty in the ITR. Everyone concerned with international tax dispute resolution – whether policymaker, in-house counsel, national tax authority official, judge, tax lawyer or academic – will find the truly valuable analysis here, not elsewhere.

Book excerpt: The most significant characteristic of the Persian Gulf is the presence of huge oil-fields under the sea-bed of its shallow waters. On the other hand, the lack of understanding among the littoral states concerning the proper exploitation of these valuable resources has led to many conflicts, and is still considered as having a very high potential for conflict. This work clarifies the international legal rules applicable to the region with particular attention to the special characteristics of the Persian Gulf, such as ethnic conflicts, lack of defined land borders, presence of numerous islands, reefs and shoals and the presence of transboundary oil deposits. It consists of a collection of materials relating to the law of the sea, including both domestic and international rules, conventions, maritime agreements, state practice, the jurisprudence of the International Court of Justice and others. The study analyses all of these important factors in order to find an equitable solution to the problems facing the international community.

Available in PDF, EPUB and Kindle. Book excerpt: A sweeping overview of the problems, politics, and policies of international and domestic management of the world's oceans. The world ocean is one of the most important global resources. Without it most life on earth would not survive because the ocean provides temperature regulation and produces oxygen, among other vital functions. However, this life-sustaining resource faces dangerous threats from over fishing, industrial wastes, oil pollution, and loss of biodiversity. Ocean Politics and Policy covers the major types of pollution, deep sea-bed mining, international jurisdictional disputes, and piracy, examining the underlying reasons for these problems and providing practical policy suggestions for reducing their impact. Special focus is placed on historical and contemporary ocean laws, from the concept of "freedom of the seas" to the 2001 Fishery Stock Agreement. Solving the problems facing the world ocean should be a high priority for the international community, and this book provides a starting place for this process.
