Pertanto un capitolo del volume introduce alle “tecniche di comunicazione”, aspetto fondamentale nell’ambito della formazione di un mediatore professionista. Il volume è strutturato in tre parti per meglio affrontare i vari aspetti dell’istituto sia per quanto riguarda le tecniche operative sia sulla formazione e i compiti degli organismi preposti a svolgere tale attività. La PRIMA PARTE focalizza l’interesse sui metodi e le tecniche che il mediatore dovrebbe utilizzare per svolgere la sua funzione. Si parla della cosiddetta “interazione comunicativa nella negoziazione e nella mediazione”; nel dettaglio si analizzano i modelli facilitativi o valutativi e aggiudicativi. Si delinea, inoltre, la funzione del giudice nella mediazione e il rapporto con i provvedimenti urgenti e cautelari. Entrando, poi, nello specifico della procedura, viene delineata la funzione specifica del mediatore e degli organismi preposti. In questo ambito vengono trattati argomenti quali la riservatezza e la responsabilità. La SECONDA PARTE si occupa esclusivamente degli ORGANISMI di mediazione e della FORMAZIONE. La TERZA PARTE infine appronta gli STRUMENTI OPERATIVI attraverso due CASI di mediazione svolti e spiegati nei vari passaggi e una CHECK LIST della procedura. - Il conflitto e le procedure ADR - La negoziazione - La gestione del conflitto nella negoziazione e nella mediazione.
