Una de estas críticas ha puesto de manifiesto la existencia de un déficit participativo en el que la ciudadanía ha quedado relegada, en la práctica, a legitimar su gobierno a través de un acto electoral cada cuatro años. Esta carencia ha sido paulatinamente paliada en la última década por parte del legislador, en especial, el de las Comunidades Autónomas. Este trabajo tiene como objeto el análisis jurídico de las posibilidades de participación que ofrece el ordenamiento jurídico infraconstitucional, constatando que se ha dado una respuesta suficiente a las demandas participativas. No obstante, este marco normativo constituye solo un punto de partida. Debe seguir mejorándose, puliendo los mecanismos existentes e incorporando otros nuevos capaces de canalizar esta intervención. Igualmente, esta regulación ha de venir acompañada de un cambio de actitud tanto de la ciudadanía, como, sobre todo, de los representantes. Estos deben abjurar de asimilar la participación con la intromisión o con un trámite más a superar en el proceso de adopción de decisiones e interiorizar que no es un elemento extraño al ejercicio de su función, sino consustancial a la misma. Los ciudadanos también debemos esforzarnos por cultivar un espíritu de colaboración y creer, en definitiva, en la utilidad de las instituciones y en el trabajo que las mismas desempeñan en el gobierno de la comunidad. La participación es, como todos los asuntos que afectan a dos o más sujetos, una cuestión de lealtad.

During the past decade, the 1999 Venezuelan Constitution has been systematically attacked by all branches of the Chávez government, particularly by the Supreme Tribunal of Justice, which has legitimized the Chávez-ordered constitutional violations. The Chávez regime has purposely defrauded the Constitution and severely restricted representative government, all in the name of a supposedly participatory democracy controlled by a popularly supported central government.
