Available in PDF, EPUB and Kindle. Book excerpt: This timely book provides the first systematic analysis of global public procurement regulation and policy during and beyond the COVID-19 pandemic. Through both thematic chapters and national case studies, this book: - explores the adequacy of traditional legal frameworks for emergency procurement; - examines how governments and international organisations have responded specifically to the pandemic; and - considers how the experience of the pandemic and the political impetus for reform might be leveraged to improve public procurement more broadly. Public procurement has been critical in delivering vital frontline public services both in the health sector and elsewhere, with procurement of ventilators, protective equipment and new hospitals all hitting the headlines. At the same time, procurers have faced the challenge of adjusting existing contracts to a new reality where, for example, some contracted services can no longer operate. Further, efficient and effective procurement will be an essential, and not a luxury, in the economic recovery. With case studies on Italy, the UK, the USA, India, Singapore, Africa, Latin America and China, the book brings together the world's leading academics and practitioners from across Europe, the Americas, Asia and Africa to examine these issues, providing an essential resource for policy makers, legislators, international organisations and academics.

Book excerpt: With the bilingual volume International Investment Law in Latin America: Problems and Prospects, Attila Tanzi, Alessandra Asteriti, Rodrigo Polanco Lazo and Paolo Turrini provide a regional perspective on one of the liveliest branches of international law by situating it in one of the most dynamic areas of the world. Latin America has always had an ambivalent relationship with international investment law and, more recently, it has been the home of harsh and resolute criticisms, questioning the ultimate legitimacy of the regime. By bringing together distinguished scholars of this legal field, the volume analyses ongoing trends and draws lessons from the Continent’s past experiences while identifying possible solutions to the important challenges it faces. Latinoamérica siempre ha tenido una relación ambivalente con el derecho internacional de inversiones y, más recientemente, ha sido el hogar de duras y decididas críticas en su contra, cuestionando la legitimidad última del régimen. Available in PDF, EPUB and Kindle. Book excerpt: This book presents, analyses and evaluates the Principles of Latin American Contract Law (PLACL), a recent set of provisions aiming at the harmonisation of contract law at a regional level. As such, the PLACL are the most recent exponent of the many proposals for transnational sets of 'principles of contract law' that were drafted or published over the past 20 years, either at the global or the regional level. These include the UNIDROIT Principles of International Commercial Contracts, the Principles of European Contract Law, the (European) Draft Common Frame of Reference and the Principles of Asian Contract Law. The PLACL are the product of a working group comprising legal academics from Argentina, Brazil, Colombia, Chile, Paraguay, Uruguay and Venezuela. The 111 articles of the instrument deal with problems of general contract law, such as formation, interpretation and performance of contracts, as well as remedies for breach. The book aims to introduce the PLACL to an international audience by putting them in their historical and comparative context, including other transnational harmonisation measures and initiatives. The contributions are authored by drafters of the PLACL and contract law experts from Europe and Latin America.

Available in PDF, EPUB and Kindle. Book excerpt: This book is a collection of meticulously gathered interviews with government officials, ambassadors, and executives involved in foreign investment and economic development in Cuba. The interviews, many for the first time with a foreign journalist, are valuable from a historical perspective and as a story of development. It offers an “open window” on Cuba into a crucial segment of the country’s economy, erroneously perceived by some as “shuttered” to the outside world. This work is structured by the contextual history of Obama’s opening with Cuba, the bleak days of Trump, the Havana Syndrome, the onset of the pandemic, the election of Biden, and his “unmet promises”, through to economic recovery of the island under the post-pandemic normal. It highlights the work of the ones who lead and invest, create opportunities for themselves and others, initiate change, trigger sustainable development, build infrastructure, improve lives, strengthen the economy, lessen suffering, and create hope. They stimulate forward progress. These are the visionaries with plans seeking to realize the full potential of Cuba, driving a new era of sustainable development and growth. By filling those gaps, this work is an important supplement for any future analysis seeking to examine the country’s potential. The book is divided into parts: government, economy, foreign investment, industrial zones, banking, law, and business, followed by interviews with top executives from Cuba’s primary sectors. This “open window” on Cuba is a compelling fresh take that shows that Cuba is open for serious business.

Available in PDF, EPUB and Kindle. Book excerpt: With the ever-increasing interconnection between markets, businesses and individuals from all over the globe, professionals are asked to develop a greater interest in the international implications of contracts. This book focuses attention on the distribution agreement, one of the most widely used contractual schemes in the practice of international exchanges, providing a analysis and information on the issues that should be considered by the practitioner when drafting, interpreting or executing an international agreement. Issues relating to the choice of the governing law, the competent court, the validity or invalidity of some clauses, the impact that the language of the contract may have, as well as the different meaning and scope of application of some principles, such as good faith and le estoppel, are analyzed from a transnational perspective, highlighting how the same issue can be regulated differently depending on the regulatory framework that governs it. In this second edition, the distribution relationship has been evaluated mainly across the legal systems of the European Union, the United States and Latin America, while not missing references to other regulatory frameworks, which are highlighted in correspondence with particular issues.

Book excerpt: Migration is an enormously broad topic of academic enquiry engaging researchers from many different social science disciplines. A wide variety of contributors from across the globe capture some of the methodological and conceptual range of migration research in the discipline of Geography today. This volume covers a large area geographically and in the expanse of subject areas involved: eighteen chapters investigate migration from, to, or within at least fifteen countries, with several sections spanning multiple places and scales. Many chapters are deeply concerned with vulnerable populations, which is not only a characteristic of much immigration scholarship but also one that connects with other areas of geography. The study of geographical assertions of sovereign power via the discourses of disorder, chaos, and crisis, shows that in these transnational times, national power is being violently reasserted, on, within, and beyond international borders. Other important topics covered include migration and climate change, "illegality", security, government policy, labor, family, and sexual orientation. This book was previously published as a special issue of Annals of the Association of American Geographers.

Available in PDF, EPUB and Kindle. Book excerpt: This paper provides an assessment of the funded pension system and the quality of the regulatory framework for both accumulation and payout phase. It suggests that the lack of portfolio diversification may contribute in the future to low returns and poor pensions and provides a number of recommendations to expand the opportunities of investments to pension funds. The paper also finds that pension fund administrators are not exploiting the scale economies in certain areas of the business such as collection of revenues and account management, and proposes mechanisms to reduce costs and increase efficiency through greater competition. The paper examines the products and options offered at retirement age and finds a bias toward the payment of pensions in the form of lump sums and suggests alternatives for improving the availability of other instruments. Enhancements to the regulatory framework of insurance companies are also proposed.
