Book excerpt: Over the course of the long and violent twentieth century, only a minority of international crime perpetrators ever stood trial, and a central challenge of this era was the effort to ensure that not all these crimes remained unpunished. This required not only establishing a legal record but also courage, determination, and inventiveness in realizing justice. Defeating Impunity moves from the little-known trials of the 1920s to the Yugoslavia tribunal in the 2000s, from Belgium in 1914 to Ukraine in 1943, and to Stuttgart and Düsseldorf in 1975. It illustrates the extent to which the language of law drew an international horizon of justice.

Book excerpt: This book is about one of the most controversial dilemmas of contract law: whether or not the unexpected change of circumstances due to the effects of financial crises may under certain conditions be taken into account. Growing interconnectedness of global economies facilitates the spread of the effects of the financial crises. Financial crises cause severe difficulties for persons to fulfill their contractual obligations. During the financial crises, performance of contractual obligations may become excessively onerous or may cause an excessive loss for one of the contracting parties and consequently destroy the contractual equilibrium and legitimate the governmental interventions. Uncomfortable economic climate leads to one of the most controversial dilemmas of the contract law: whether the binding force of the contract is absolute or not. In other words, unstable economic circumstances impose the need to devote special attention to review and perhaps to narrow the binding nature of a contract. Principle of good faith and fair dealing motivate a variety of theoretical bases in order to overcome the legal consequences of financial crises. In this book, all these theoretical bases are analyzed with special focus on the available remedies, namely renegotiation, rescission or revision and the circumstances which enables the revocation of these remedies. The book collects the 19 national reports and the general report originally presented in the session regarding the Effects of Financial Crises on the Binding Force of Contracts: Renegotiation, Rescission or Revision during the XIXth congress of the International Academy of Comparative Law, held in Vienna, July 2014.

Book excerpt: In the World War I era, veterans fought for a unique right: access to government-sponsored health care. In the process, they built a pillar of American social policy. Burdens of War explores how the establishment of the veterans’ health system marked a reimagining of modern veterans’ benefits and signaled a pathbreaking validation of the power of professionalized institutional medical care. Adler reveals that a veterans’ health system came about incrementally, amid skepticism from legislators, doctors, and army officials concerned about the burden of long-term obligations, monetary or otherwise, to ex-service members. She shows how veterans’ welfare shifted from centering on pension and domicile care programs rooted in the nineteenth century to direct access to health services. She also traces the way that fluctuating ideals about hospitals and medical care influenced policy at the dusk of the Progressive Era; how race, class, and gender affected the health-related experiences of soldiers, veterans, and caregivers; and how interest groups capitalized on a tense political and social climate to bring about change. The book moves from the 1910s—when service members requested better treatment, Congress approved new facilities and increased funding, and elected officials expressed misgivings about who should have access to care—to the 1930s, when the economic crash prompted veterans to increasingly turn to hospitals for support while bureaucrats, politicians, and doctors attempted to rein in the system. By the eve of World War II, the roots of what would become the country’s largest integrated health care system were firmly planted and primed for growth. Drawing readers into a critical debate about the level of responsibility America bears for wounded service members, Burdens of War is a unique and moving case study. -- Jennifer D. Book excerpt: Twentieth-century war is a unique cultural phenomenon and the last two decades have seen significant advances in our ability to conceptualize and understand the past and the character of modern technological warfare. At the forefront of these developments has been the re-appraisal of the human body in conflict, from the ethics of digging up First World War bodies for television programmes to the contentious political issues surrounding the reburial of Spanish Civil War victims, the relationships between the war body and material culture (e.g. clothing, and prostheses), ethnicity and identity in body treatment, and the role of the ‘body as bomb’ in Iraq, Afghanistan and beyond. Focused on material culture, Bodies in Conflict revitalizes investigations into the physical and symbolic worlds of modern conflict and that have defined us as subjects through memory, imagination, culture and technology. The chapters in this book present an interdisciplinary approach which draws upon, but does not privilege archaeology, anthropology, military and cultural history, art history, cultural geography, and museum and heritage studies. The complexity of modern conflict demands a coherent, integrated, and sensitized hybrid approach which calls on different disciplines where they overlap in a shared common terrain - that of the materiality of conflict and its aftermath in relation to the human body. Bodies in Conflict brings together the diverse interests and expertise of a host of disciplines to create a new intellectual engagement with our corporeal nature in times of conflict.

Available in PDF, EPUB and Kindle. Book excerpt: On 11 November 1918 the guns on the Western Front finally fell silent. In this insightful book, some of Belgium's most renowned historians explain how their country struggled back to its feet after four long years of wartime misery. Many towns and villages had been razed to the ground, factories had been plundered, and harbour installations destroyed. Unemployment was at unprecedented levels, there was an acute shortage of food, and sickness and disease weakened the population. This thoughtful series of essays by leading military, political and social historians chart the immense toll the war took on all aspects of Belgian life, and explore how post-war economic and social changes ushered in the Roaring Twenties; the colourful, frivolous, flamboyant and turbulent decade that was characterised by the rise of the avant-garde, jazz, flapper dresses, and the emergence of modern media such as radio, film and photography. Available in PDF, EPUB and Kindle. Book excerpt: The break-up of the Soviet Union, Yugoslavia and Czechoslovakia and the unification of Germany in the 1990s marked the dramatic return to center stage in international law of the issue of State succession. This book deals with one particularly controversial aspect of State succession that until now has not received much attention: the question of State succession to international responsibility. In State Succession to International Responsibility the international lawyer and scholar Patrick Dumberry addresses the question, critical for our times, whether or not a new State may be held responsible for wrongful acts committed before its independence by the predecessor State. He also considers the reverse situation: whether or not a new State may claim reparations for wrongful acts committed before its independence by third parties and which affected the predecessor State or one of its nationals. State Succession to International Responsibility contains the most comprehensive analysis ever published of doctrine and State practice related to these questions. It is the first attempt to examine systematically State conduct, both historical and modern, with a view to identifying the factors and circumstances under which rights and obligations of a predecessor State may be transferred to a new State.
