Notre étude démontre que l’obligation de mise en concurrence au statut de l’obligation fonctionnelle dans le cadre de passation des contrats de la commande publique doit être considérée comme un moyen garantissant le respect des principes de la commande publique, ainsi que l’efficacité et la transparence de l’emploi des fonds publics. Elle ne doit pas pour autant être confondue avec le droit de la concurrence, dont l’application en matière est aujourd’hui également acquise. D’une manière plus générale, notre étude démontre que l’introduction des exigences communautaires en droit interne des contrats de la commande publique a eu pour conséquence la remise en cause des fondements mêmes du droit de la commande publique au niveau des définitions, des typologies des contrats, des régimes juridiques, mais également au niveau du contrôle tant juridictionnel, que celui émanant d’autorités indépendantes

Elles ont élaboré une véritable réglementation qui redéfinit la notion, impose un régime de passation et un régime contentieux, le tout sous l'égide des principes de non discrimination, de transparence, d'égalité et de mise en concurrence. Le droit communautaire de la commande publique ne se limite pas à ces textes, il faut y inclure, les principes des Traités, la jurisprudence de la Cour et les avis de la Commission. Le droit interne a dû intégrer cet ensemble sous peine de sanction, l'obligeant à se réformer pour être " euro-compatible ". Aujourd'hui, on peut s'interroger sur cette influence, et déterminer ce que le droit français de la commande publique a gardé de ses 200 ans de traditions. Cette étude s'attache à examiner et comparer la réglementation européenne et nationale au travers des éléments constitutifs et distinctifs de la notion de marchés publics, ses procédures et son contentieux, démontrant la prépondérance du droit européen sur notre droit national.
