Book excerpt: La réparation des accidents du travail et des maladies professionnelles est régie par la loi du 9 avril 1898, loi de compromis votée lors du développement du machinisme et de l'apparition du phénomène accidentel, dans le but de permettre aux salariés victimes de bénéficier d'uen réparation automatique, mais forfaitaire, de leurs dommages. L'intention, louable, qui a animé le législateur du XIXème siècle a cependant rapidement été rattrapée par la réalité et les évolutions juridiques. Les principes posés par la loi de 1898 et par les lois subséquentes, qui interdisent en principe à la vitime d'un accident du travail ou à ses ayants droit d'agir sur le fondement du droit commun, sont en effet de plus en plus critiqués dans la mesure où, paradoxalement, ils sont aujourd'hui moins favorables que ceux qu gouvernent le droit de la responsabilité civile. Cette dernière, notamment caractérisée par le principe de réparation intégrale des préjudices, a en effet fait l'objet de nombreuses transformations, qui ont largement facilité la réparation. Le législateur et la jurisprudence s'efforcent par conséquent de rapprocher le régime des accidents du travail et des maladies professionnelles de la responsabilité civile de droit commun. Cependant, la tendance au rapprochement, voire à l'harmonisation, entre le régime des accidents du travail et des maladies professionnelles et celui de la responsabilité civile, n'est pas univoque. Indéniablement, le contentieux des accidents du travail et des maladies professionnelles a lui aussi une incidence sur la responsabilité civile, en témoigne le fait qu'il soit à l'origine de la découverte de l'obligation de sécurité de résultat pesant sur l'employeur, source d'une systématicité de la dette de réparation. Toutefois, la présente étude s'attache à mettre en exergue que c'est de manière générale, en réalité, que le régime des accidents du travail et des malaies professionnelles est une source d'inspiration du droit de la responsabilité civile, eu égard à la traditionnelle dialectique entre le droit commun et les droits spéciaux. Il existe donc une interdépendance entre le contentieux des accidents du travail et des maladies professionnelles et la responsabilité civie , dans la mesure où ces deux contentieux se servent mutuellement de modèle, et évoluent en contemplation l'un de l'autre.

Finally, he shows how the independent states of the postcolonial era, in particular Burundi, Rwanda, and Uganda, have been trapped by their colonial and precolonial legacies, especially by the racial rewriting of the latter by the former.
