Book excerpt: O presente estudo objetivou analisar a repartição das competências das entidades políticas previstas pela Constituição Federal de 1988, e, especificamente, demonstrar os aspectos que norteiam a competência legislativa dos municípios sobre matéria constitucional de Direito Ambiental. Compreende-se a pertinência temática do assunto abordado justamente pela relevância deste no campo social e jurídico, posto que a legalidade do município legislar sobre matéria de meio ambiente local pode tornar mais eficazes as políticas ambientais, uma vez que os municípios estão na base do problema ambiental. Verificou-se que para se mensurar a validade de lei municipal que verse sobre o meio ambiente, devem ser observados os seguintes standards: existência ou não de lei federal e estadual que trate do tema; se houver lei federal ou estadual, verificar se a lei municipal é mais ou menos protetiva do ambiente; se houver lei federal ou estadual, verificar se estas permitem expressamente que o município adote regra mais restritiva ou menos protetiva do ambiente; avaliar se a lei municipal considerou peculiaridades municipais ou se no caso concreto não existe interesse local distinto do regional ou nacional apto a justificar regra diversa para o ente local. Conclui-se, portanto, que a autonomia do município, com o atributo de Princípio constitucional que é, encontra-se intrinsecamente relacionada a este conceito não definido pela Constituição de 1988, qual seja, interesse local. Porém, o alcance de tal proposição é determinado pela conjugação deste termo com os demais dispositivos constitucionais.
