Available in PDF, EPUB and Kindle. Book excerpt: The introduction of a National Lottery into the United Kingdom created a unique regulatory challenge. The response to this challenge is embodied in arrangements informed not by international precedent but by privatisation policies pursued by successive Conservative governments between 1979 and 1994 when the Lottery was launched. Dr Douglas assesses the success of the Lottery's regulation against the objectives set out in the enabling legislation: the upholding of the Lottery's propriety, the protection of the players, and the maximising of the funds to be applied to the Good Causes. Lessons learned during the initial Licence period will inform the new seven year Licence from October 2001, the operator chosen for the new term, and in particular the role of the profit motive within the new arrangements.

This book was released on 2012-07-24 with total page 402 pages. Available in PDF, EPUB and Kindle. Book excerpt: High street betting shops and casinos alike are currently allowed a maximum of four B2 (FOBT) gaming machines, which allow stakes up to £100 and a £500 prize. Casinos, should instead be permitted to operate up to twenty B2-type gaming machines. Limiting the number of B2 machines in betting shops has encouraged them to cluster in some high streets in order to satisfy customer demand. Local Authorities should have the power to permit more than the four B2 machines per shop if they believe it will help with clustering. The Committee also recommends that any local authority be able to make the decision as to whether or not they want a casino. As a step towards this, existing 1968 Act Casino licences should be made portable, allowing operators to relocate to any local authority provided that they continue to be constrained by the need to obtain local authority approval, a premises licence and planning permission. The failure to set remote gambling taxation at a level at which online operators could remain within the UK has led to almost every online gambling operator moving offshore whilst most are still able to advertise and operate into the UK. The Committee further recommends the Gambling Commission should introduce a new licence fee structure which reduces the current anomaly where small, independent bookmakers pay much higher fees per shop than large chains. Particularly given the absence of a significant UK-regulated online sector or any Regional Casinos, the Gambling Commission remains an overly expensive, bureaucratic regulator.

Book excerpt: The Gambling Law Review, edited by Carl Rohsler of Squire Patton Boggs, enables a lawyer or executive to swiftly and effectively 'plug in' to the regulatory and legal structure of a wide range of jurisdictions across the world, and understand in a few pages the legal climate, the likely issues that will arise in doing business in that jurisdiction and the overall legal risk. Gambling law in many jurisdictions has changed and evolved significantly, but the essential predicament remains the same: staying on top of the hugely varied and constantly changing corpus of law and regulation. There are in-depth examinations of gambling in law in 24 jurisdictions as well as editorial chapters on Gambling: a Legal And Philosophical Overview, an Overview of US Federal Gaming Law as well as Gambling and European Law. Contributing firms include: Addisons Lawyers, McCann FitzGerald, Brownstein Hyatt Farber Schreck LLP, and Squire Patton Boggs.

This book contains a full account of judicial review, the traditional heartland of administrative law, and adds to this by taking into account the concerns of government, officials and agencies who operate and shape the law. It also looks at the possible future of administrative law in an increasingly automated and digitalised world. A fully revised and updated new edition, this book includes new case studies of regulatory agencies and government contracting to develop understanding of law in practice.

Book excerpt: Since the 1990s the European Court of Justice has provided an institutional backdrop from which the requirements of EU law regarding gambling regulation are evolving. Given the total absence of harmonisation, Member States are competent to regulate gambling conditional upon such regulation being compatible with EU law. This book analyses the regulatory approaches undertaken in France, the Netherlands and the United Kingdom regarding a variety of forms of online and offline gambling with a view to assessing the compatibility of these approaches. Furthermore it illustrates prevailing commonalities between the regimes and injects a degree of realism into the debate, softening the hard stance taken by stakeholders at opposite ends of the policy spectrum.

Book excerpt: Gambling is a significant global industry, which is worth around 0.6% of world trade, that is, around US$ 384 billion; and gambling on the outcome of sports events is a very popular pastime for millions of people around the world, who combine a bet with watching and enjoying their favourite sports. But, like any other human activity, sports betting is open to corruption and improper influence from unscrupulous sports persons, bookmakers and others. Sports betting in the last ten years or so has developed and changed quite fundamentally with the advent of modern technology – not least the omnipresence of the Internet and the rise of on-line sports betting. This book covers the law and policy on sports betting in more than forty countries around the world whose economic and social development, history and culture are quite different. Several chapters deal with the United States of America. This book also includes a review of sports betting under European Union (EU) Law. The book appears in the ASSER International Sports Law Series, under the editorship of Dr. Robert Siekmann, Dr. Janwillem Soek and Marco van der Harst LL.M.

This book was released on 2015 with total page 45 pages. Available in PDF, EPUB and Kindle. Book excerpt: Society lotteries are intended to be primarily a means of raising money for charities and other good causes. The vast majority are small, often local, and raise sums of money that, though not substantial, are vital for the work of the organisations they support. The Gambling Act 2005 relaxed some of the restrictions on such lotteries. This was not a cause of concern until the recent launch of some larger, 'umbrella' lotteries, advertised nationally, run by commercial operations and giving close to the statutory minimum percentage of the proceeds of ticket sales to the good causes they supported. These are controversial in part because they are alleged to stretch the definition of a society lottery as primarily intended to raise money for good causes, and in part because they are seen by some as direct competitors to the National Lottery. As a result, there have been calls for restrictions to be imposed on large society lotteries, while others have suggested the success of the umbrella lotteries could be replicated elsewhere if regulations on society lotteries were relaxed. The Committee has been guided in its approach by the principle that the regulatory regime governing society lotteries should encourage the maximum return to good causes and, provided that the lottery remains focused on its primary purpose, the licensing regime should be light, including continued exemption from gambling and lottery taxes. Accordingly, the Committee recommends greater differentiation between the regulations applied to the great majority of lotteries, which are small and local, and those applied to larger ones, especially those run on behalf of the good causes by commercial organisations, which tend to return smaller proportions of their funds to the charity than single-cause lotteries.
