The policy is divided into three coverage sections-each with its own exclusions-and a supplementary payments section. Do you ever hear-or worry-that an insurance company will not pay a claim because coverage is excluded? In order to know how claims are paid, you need to understand the policy's insuring agreements and exclusions. In this book, attorney and insurance professional Dwight M. Kealy explains the insuring agreements in Coverage A, B, and C. He gives memorable examples of every standard exclusion-and some significant non-standard exclusions. He explains every supplementary payment, and he explains how policy limits impact how claims are paid.

Book Synopsis The Liability Century by : Kenneth S. Abraham
Download or read book The Liability Century written by Kenneth S. Abraham and published by Harvard University Press. This book was released on 2008-03-31 with total page 287 pages. Available in PDF, EPUB and Kindle. Book excerpt: Kenneth Abraham explores the development and interdependency of the tort liability regime and the insurance system in the United States during the twentieth century and beyond, including the events of September 11, 2001. From its beginning late in the nineteenth century, the availability of liability insurance led to the creation of new forms of liability, heavily influenced expansion of the liabilities that already existed, and continually promoted increases in the amount of money that was awarded in tort suits. A “liability-and-insurance spiral” emerged, in which the availability of liability insurance encouraged the imposition of more liability, and, in turn, the imposition of liability encouraged the further spread of insurance. Liability insurance was not merely a source of funding for ever-greater amounts of tort liability. Liability insurers came to dominate tort litigation. They defended lawsuits against their policyholders, and they decided which cases to settle, fight, or appeal. The very idea behind insurance––that spreading losses among large numbers of policyholders is desirable––came to influence the ideology of tort law. To serve the aim of loss spreading, liability had to expand. Today the tort liability and insurance systems constantly interact, and to reform one the role of the other must be fully understood.
Book Synopsis Ensuring Corporate Misconduct by : Tom Baker
Download or read book Ensuring Corporate Misconduct written by Tom Baker and published by University of Chicago Press. This book was released on 2011-01-15 with total page 295 pages. Available in PDF, EPUB and Kindle. Book excerpt: Shareholder litigation and class action suits play a key role in protecting investors and regulating big businesses. But Directors and Officers liability insurance shields corporations and their managers from the financial consequences of many illegal acts, as evidenced by the recent Enron scandal and many of last year’s corporate financial meltdowns. Ensuring Corporate Misconduct demonstrates for the first time how corporations use insurance to avoid responsibility for corporate misconduct, dangerously undermining the impact of securities laws. As Tom Baker and Sean J. Griffith demonstrate, this need not be the case. Opening up the formerly closed world of corporate insurance, the authors interviewed people from every part of the industry in order to show the different instances where insurance companies could step in and play a constructive role in strengthening corporate governance—yet currently do not. Ensuring Corporate Misconduct concludes with a set of readily implementable reforms that could significantly rehabilitate the system.

Book Synopsis Deregulating Property-Liability Insurance by : J. David Cummins
Download or read book Deregulating Property-Liability Insurance written by J. David Cummins and published by Rowman & Littlefield. This book was released on 2004-06-23 with total page 421 pages. Available in PDF, EPUB and Kindle. Book excerpt: Over the past two decades, the United States has successfully deregulated prices and restrictions on most previously-regulated industries, including airlines, trucking, railroads, telecommunications, and banking. Only a few industries remain regulated, the largest being the property-liability insurance business. In light of recent sweeping financial modernization legislation in other sectors of the insurance industry, this timely volume examines the basis for continued regulation of rates and forms of the U.S. property-liability insurance market. The book focuses on private passenger automobile insurance—the most important personal line of property-liability coverage, with annual premiums of about $120 billion. The authors analyze five state case studies: California, Massachusetts, and New Jersey—three of the most heavily regulated states—as well as Illinois, which has been deregulated for about 30 years, and South Carolina, which began to deregulate in 1997. The study also includes an econometric analysis based on all fifty states over a 25-year period that gauges the impact of regulation on insurance price levels, price volatility, and the proportion of automobiles insured in residual markets. The authors conclude that regulation does not significantly reduce long-run prices for consumers, and generally limits availability of coverage, reduces the quality and variety of services available in the market, inhibits productivity growth, and increases price volatility.
