Book Synopsis Good Administration and the Council of Europe by : Ulrich Stelkens
Download or read book Good Administration and the Council of Europe written by Ulrich Stelkens and published by Oxford University Press. This book was released on 2020-09-11 with total page 912 pages. Available in PDF, EPUB and Kindle. Book excerpt: Good Administration and the Council of Europe: Law, Principles, and Effectiveness examines the existence and effectiveness of written and unwritten standards of good administration developed within the framework of the Council of Europe (CoE) and in the case law of the European Court of Human Rights. These standards - called 'pan- European general principles of good administration' - cover the entire range of general organizational, procedural, and substantive legal institutions meant to ensure a democratically legitimized, open, and transparent administration respecting the rule of law. They are about the 'limiting function' of administrative law: its function to protect individuals from arbitrary power, to legitimize administrative action, and to combat corruption. This book analyses the sources and functions of the pan-European general principles of good administration and seeks to uncover how deeply they are rooted in the domestic legal systems of the CoE Member States. It comprises 28 country reports dedicated to an in-depth exploration of the impact of these standards on the national legal systems of the Member States written by respective experts on these systems. It argues that the pan-European general principles of good administration lead to a certain harmonization of the legal orders of the Member States with regard to the limiting function of administrative law despite the many fundamental differences between their administrative and legal systems. It comes to the further conclusion that the pan-European general principles of good administration can be considered as a concretization of the founding values of the CoE and describes the 'administrative law obligations' a Member State entered into when joining the CoE.

Book Synopsis General Principles and Sector-Specific Rules in European Administrative Laws by : Giacinto della Cananea
Download or read book General Principles and Sector-Specific Rules in European Administrative Laws written by Giacinto della Cananea and published by Oxford University Press. This book was released on 2024-07-04 with total page 353 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the field of administrative law, there is no systematic body of rules similar to those characteristic of European civil codes. General principles are therefore of fundamental importance. This volume - the sixth in the series concerning the common core of European administrative laws - explores this importance through two strands. Firstly, it examines in detail the relationship between general principles of law, such as due process, and sector-specific rules established by legislative and regulatory provisions, for example in licensing and disciplinary matters. Several questions about the nature of general principles emerge through this analysis. Are general principles about filling gaps? Or do they have a foundational role because they give meaning to the values that are shared by European legal systems, such as respect for the rule of law and for fundamental rights? Secondly, this volume also explores the interaction between commonality and diversity in European administrative law. It considers whether there are shared standards of administrative conduct, including the duty to give reasons, or if there are fundamental differences with regard to non-European legal systems, such as that of China and Venezuela. These questions are investigated through factual analysis, based on a set of hypothetical cases, which are discussed by national experts. This book then scrutinizes these questions to determine how commonality and diversity have extended and interact with one another, within and across legal systems, both diachronically and synchronically, over the course of a century. It shows that there are both unexpected areas of agreement between the European legal systems, notably concerning the right to be heard (expressed by the maxim audi alteram partem) and the duty to give reasons, and there are also areas of disagreement, for example as far as the right to remain silent vis ? vis the administration (that is, nemo tenetur se detegere) is concerned.

Book Synopsis Comparative intervention with minors in different countries by : Concepción Nieto Morales
Download or read book Comparative intervention with minors in different countries written by Concepción Nieto Morales and published by Dykinson. This book was released on with total page 149 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the present course dedicated to minors, the participants will show us, in a schematic and very clearly way, the legal approach concerning the treatment that the respective States give the child, both in the field of protection, as in the one of the criminal responsibility for the commission of a crime or misdemeanor. Under this view of comparative law, there is the opportunity to meet the criminal procedure applied to children in conflict with the law, the age group from which criminal responsibility is required, the specialization of all the professionals involved from judges, prosecutors, lawyers, police, etc., involved in the area of the minor concerning the adversarial principle or the procedural guarantees for juvenile offenders. Regarding the enforcement of judicial measures, the central axis is education and the socialization of teenagers. However, each country has its own uniqueness and, in custodial measures, the age and type of crime are important in some countries. The part concerning extrajudicial solutions is highly informative, especially the part related to the Institute of mediation, where the participation of the victim is essential. I hope that reading and participation arouse in you the enthusiasm for me experienced, and that the efforts of its participants will be compensated with the learning and sensitization in the treatment of the child... Book Synopsis Government Communication by : Karen Sanders
Download or read book Government Communication written by Karen Sanders and published by A&C Black. This book was released on 2013-06-20 with total page 337 pages. Available in PDF, EPUB and Kindle. Book excerpt: Government communication is a curiously neglected area of discursive analysis. No considered examination of the subject exists which provides either an account of the contemporary governmental landscape or an explanation of the common and divergent themes on both a domestic and international basis. This volume aims to fill that gap, providing a concise and illuminating case-study based review of government communication. It will be divided into three sections to reflect differences in both geography and political allegiances, scrutinizing continental Europe, Anglo-American traditions and newly emerging democracies. Offering a global and thematic account, it is an indispensable resource for all students of political communication.

Book Synopsis Legitimacy in European Administrative Law by : Dornburg Research Group on New Administrative Law. Workshop
Download or read book Legitimacy in European Administrative Law written by Dornburg Research Group on New Administrative Law. Workshop and published by Trans Pacific Press. This book was released on 2011 with total page 380 pages. Available in PDF, EPUB and Kindle. Book excerpt: Administrative law has been the object of thorough reform in various European jurisdictions. This process of transformation has considerable impacts on administrative legal scholarship in the respective countries. Profound changes in administrative activity have established new forms of administrative institutions which raise issues of legitimacy. Besides the consensus that administrative law, administrative activities, and administrative institutions have to be legitimate, the concept of legitimacy with respect to a common European framework is more than ambiguous. An analysis of the concept of legitimacy in different national legal systems promises valuable results for a discussion on the European Union level. Although the respective jurisdictions have different starting points with respect to issues of legitimacy, common sources can be detected. This is necessary in shaping and analyzing administrative law in the EU. This book comprises the results of the third workshop of the Dornburg Research Group of New Administrative Law, which took place in Paris in October 2009. The Dornburg Research Group of New Administrative Law was founded at Dornburg Castle near Jena, Germany, in 2005. Its purpose is a long-term transnational exchange of ideas between administrative law scholars from European jurisdictions.
