La force des gouvernants n'est point légitime en soi, mais seulement lorsqu'elle est employée à sanctionner le droit, c'est-à-dire à garantir toute coopération à la solidarité sociale. Ainsi l'État n'est point le représentant exclusif de l'intérêt collectif ; il est la force consciente devant protéger la solidarité sociale, synthèse féconde de l'intérêt individuel et de l'intérêt collectif. [...] Des consciences et des volontés individuelles solidaires les une des autres, une règle fondée sur cette solidarité, loi des consciences et des volontés individuelles ; des individus plus forts que les autres qui, en vertu de cette règle, doivent mettre leur force au service de la solidarité ; constatation de cette règle par les gouvernants et organisation de moyens destinés à la sanctionner ; voilà l'État, le droit objectif et la loi positive. Les notions de personnalité étatique, de souveraineté, de sujet de droit ne répondent point à la réalité et doivent être définitivement bannies. (Léon Duguit)

Par la multiplication d'objectifs nouveaux au sein de la Constitution ou des lois, l'Etat entend également agir sur d'autres systèmes : l'économie, l'environnement ou le marché pour produire des transformations. Cela ne va pas sans révéler son rôle tutélaire et son ambition à faire évoluer les pratiques et les moeurs. Mais, sous l'illusion de poursuivre des objectifs incontestables, n'exerce-t-il sa propagande en " politisant" et instrumentalisant le droit pour les besoins de sa propre légitimité ? Le colloque de La Rochelle des 25 et 26 septembre 2009 explique et tire les enseignements dans la théorie du droit et de l'Etat de la présence croissante de dispositions juridiques prenant la forme d'objectifs en abordant notamment le problème par les disciplines des droits public et privé afin d'en rendre plus exactement et actuellement compte sur les plans à la fois théorique et pratique.
