Book excerpt: This book focuses on recent developments in consumer law, specifically addressing mandatory disclosures and the topical problem of information overload. It provides a comparative analysis based on national reports from countries with common law and civil law traditions in Asia, America and Europe, and presents the reports in the form of chapters that have been drafted on the basis of a questionnaire, and which use the same structure as the questionnaire to allow them to be easily compared. The book starts with an analysis of the basic assumptions underlying the current consumer protection models and examines whether and how consumer models adapt to the new market conditions. The second part addresses the information obligations themselves, first highlighting the differences in the reported countries before narrowing the analysis down to countries with a general pre-contractual information duty, particularly the transparency requirements that often come with such a duty. The next part examines recent developments in the law on food labelling, commercial practices and unfair contract terms in order to identify whether similar traits can be found in European and non-European jurisdictions. The fourth part of the book focuses on specific information obligations in the financial services and e-commerce sectors, discussing the fact that legislators are experimenting with different forms of summary disclosures in these sectors. The final part provides a critical appraisal of the recent developments in consumer information obligations, addressing the question of whether the multiple criticisms from behavioural sciences necessitate abandonment or refinement of current consumer information models in favour of new, more adequate forms of consumer protection, and providing suggestions.

Further, it identifies the differences in the data protection systems of EU member states and examines the development of common standards and principles of data protection that could help build a data protection model for Mercosur. Divided into four parts, the book starts out with a discussion of the evolution of the right to privacy, focusing on the last few decades, and taking into account the development of new technologies. The second part discusses the interaction between data protection and specific industries that serve as case studies: insurance, banking and credit reporting. The focus of this part is on generalization and discrimination, adverse selection and the processing of sensitive and genetic data. The third part of the book presents an analysis of the legislation of three EU Member States (France, Italy and UK). Specific elements of analysis that are compared are the concepts of personal and anonymous data, data protection principles, the role of the data protection authorities, the role of the data protection officer, data subjects’ rights, the processing of sensitive data, the processing of genetic data and the experience of the case studies in processing data. The book concludes with the proposal of a model for data protection that could be adopted by Mercosur, taking into account the different levels of data protection that exist in its member states.

Cet ouvrage explore une dimension encore inédite de la vidéosurveillance. Elle réside dans le caractère automatique de la détection des « comportements anormaux » dans l'espace public. L'anormalité est un enjeu fondamental dans la définition de la citoyenneté, en établissant une frontière entre ce qui est jugé acceptable et ce qui doit être réprimé. Or, des projets de recherches appliqués récents tentent de coupler l'usage de la vidéosurveillance avec une évaluation automatique de l'anormalité. Désormais, les algorithmes contribuent à définir ces comportements anormaux et donc, dessinent les figures de l’anormal. L’automaticité modifie considérablement les capacités d’appréciation de la normalité, jusqu’ici de la compétence du juge et des pouvoirs publics. La convergence des techniques (vidéo, base de données informatiques...) contribue à modifier profondément les frontières de l’espace public et, par conséquent, de l’espace démocratique. L’ouvrage présente les débats interdisciplinaires qui ont eu lieu à l’occasion d’une application technique actuellement en cours. S’interroger sur ce qu’est un comportement anormal permet de rappeler les modalités d’élaboration de la normalité dans une démocratie.
