Ils ont en réalité au nombre de six : les principes de généralité et d'équivalence, la réparation intégrale, l'appréciation au jour du jugement, l'appréciation in concreto, l'absence d'obligation de minimiser le dommage et la libre utilisation des indemnités. Tous assurent la mise en œuvre de la fonction indemnitaire du droit de la responsabilité civile. Bien qu'applicables, ces principes ne sont pas toujours garantis dans le cadre de la réparation du dommage corporel. Leur portée est bien souvent limitée en théorique comme en pratique (ce dommage étant souvent qualifié « d'irréparable) ; par ailleurs, l'usage d'outils de détermination et de chiffrage des préjudices consécutifs à un dommage corporel ne permet pas toujours de mettre en œuvre les principes de la réparation. Cette étude formule donc plusieurs propositions pour sauvegarder l'application des principes et les renforcer au cours du processus de réparation du dommage corporel, en procédant à quelques adaptations. Elle suggère également une réforme de la nomenclature des postes de préjudices réparables et des autres outils de détermination et de chiffrage afin de les transformer en de véritables vecteurs d'application des principes dans le quotidien des acteurs de la réparation. D'autres formes de réparation du dommage corporel sont également envisagées comme la réparation en nature et la réparation non indemnitaire via des mesures symboliques ou de justice restaurative. L'ensemble de ces propositions vise à garantir la correcte application des principes de la réparation aux victimes de dommage corporel.

Book excerpt: The Violence of Modernity turns to Charles Baudelaire, one of the most canonical figures of literary modernism, in order to reclaim an aesthetic legacy for ethical inquiry and historical critique. Works of modern literature are commonly theorized as symptomatic responses to the trauma of history. In a climate that tends to privilege crisis over critique, Debarati Sanyal argues that it is urgent to rethink literary experience in terms that recall its contestatory potential. Examining Baudelaire's poems afresh, she shifts the focus of critical attention toward an account of modernism as an active engagement with violence, specifically the violence of history in nineteenth-century France. Sanyal analyzes a literary current that uses the traditional hallmarks of modernism—irony, intertextuality, self-reflexivity, and formalism—to challenge the historical violence of modernity. Baudelaire and the committed ironists writing in his wake teach us how to read and resist the violence of history, and thereby to challenge the melancholy tenor of our contemporary "wound culture." In a series of provocative readings, Sanyal presents Baudelaire's poetry as an aesthetic form that contests historical violence through rhetorical strategies of complicity, counterviolence, and critique. The book develops a new account of Baudelaire's significance as a modernist by dislodging him both from his traditional status as a practitioner of "art for art's sake" and from his more recent incarnation as the poet of trauma. Following her extended analysis of Baudelaire's poetry, Sanyal in later chapters considers a number of authors influenced by his strategies—including Rachilde, Virginie Despentes, Albert Camus, and Jean-Paul Sartre—to examine the relevance of their interventions for our current climate of trauma and terror. The result is a study that underscores how Baudelaire's legacy continues to energize literary engagements with the violence of modernity.

Il est vrai que le Code civil ne lui accorde que très peu d’attention au point que la matière ne semble balisée que par quelques principes généraux, le reste étant laissé à l’appréciation des tribunaux. Cette liberté est elle-même la source de distorsions importantes sous l’angle de l’évaluation des dommages, distorsions que le principe de la réparation in concreto ne suffit pas toujours à expliquer. Il importe donc de maintenir une veille constante sur l’évolution de la jurisprudence en ce domaine. L’examen du tableau indicatif dans sa version 2012 s’impose de lui-même en raison de son actualité. La notion même d’incapacité, concept clé en matière d’évaluation du préjudice corporel, retiendra particulièrement l’attention car elle peut recouvrir plusieurs sens. Une incapacité peut d’ailleurs parfaitement se concevoir même si la victime ne gagne aucun revenu (enfants, étudiants, ménagères). L’absence de cette référence rend cependant l’évaluation du dommage économique plus délicate. On s’y attardera également tant il est vrai que cette question n’a pas toujours retenu l’attention qu’elle mérite. Le préjudice, on le sait, peut être subi directement ou indirectement. Dans ce dernier cas, on parlera d’un préjudice par répercussion ou par ricochet. Le préjudice par répercussion a ceci de particulier qu’il se présente comme un préjudice certes personnel mais qui ne se conçoit pas indépendamment d’une atteinte préalable subie par la victime directe. Il importe de réfléchir sur la nature particulière du préjudice par répercussion et sur les liens de dépendance qu’il fait naître. L’examen de quelques questions spéciales relatives à l’indemnisation des préjudices résultant du décès terminera cette analyse. De prime abord, il reste choquant que le préjudice résultant du décès fasse l’objet d’une indemnisation souvent plus réduite qu’en cas de lésions corporelles.
