After almost three decades of deregulation driven by a belief in the self-equilibrating properties of the market, the financial crisis of 2008 has reminded everyone of the fundamental truth that markets have legal and institutional foundations, without which they cannot effectively function. The chapters in the present volume are the result of work by a group of legal scholars which began in the mid-2000s, at a time when the shortcomings of deregulatory policies were becoming clear in a number of contexts. The chapters address the question of how the language of contract law describes or conceptualises the market order and the relationship of the law to it. The perspectives taken are, in turn, historical, comparative, and context-specific. The focus of the book is on a foundational idea, the concept of capacitas, which signifies a status conferred upon citizens for the purpose of enabling them to participate in the economic life of the polity. In modern legal systems, 'capacity' is the principal juridical mechanism by which individuals and entities are empowered to enter into legally binding agreements and, more generally, to arrange their affairs using the instruments of private law. Legal capacity is thereby the gateway to involvement in the operations of a market economy.

Book excerpt: "In FELICIE, the focus is on the health of the elderly, and on the resources at their disposal to cope with the severe impairments liable to affect their quality of life. Not only personal resources - economic well-being and educational attainment - but also the potential support of close kin, i.e. their partner, of course, and their children, if available. This leads to the more specific question of care. One major conclusion of the FELICIE study is that the disabled older adults of the future will fare better, on average, than those of today, both on a personal level, thanks to higher levels of education, and on a social level, thanks to the more frequent presence of their spouse and, at least potentially, their children. The conclusions are based on the experience of nine countries across Europe (north: Finland, Netherlands; west: Belgium, France, Germany, United Kingdom; south: Italy, Portugal; east: Czech Republic). Book excerpt: In the early stages of planning the Third International Conference in System Science in Health Care, the steering committee members, most of whom had participated in the first conference in Paris (1976) and the second in Montreal (1980), made some basic decisions about organization of subject matter. The earlier meetings had been very successful in bringing together specialists from the health professions and the traditional sciences. In addition to physicians and nurses, these were representatives of the disciplines of the behavioral sciences, system theory, economics, engineering, and the emergency fields of management science and informatics -all concerned with the development of health resources in a broad system context. The reported research and experience of the many disciplines represented had dealt with one or more of three concerns: 1) a major health problem, such as cardiovascular disease, or an important popUlation at risk, such as the elderly or children or workers; 2) some generic aspect of organization and decision making, including trial and evaluation ofinnovative health strategies; and 3) the methodology of research and analysis in system of health service. The challenge to the conference organizers lay in the eliciting and arranging of experiences in such a way that the health services could be seen as purposeful,living, evolving systems.
