Book excerpt: Cette thèse a pour objectif de comprendre la mission de la loi pénale, son application par les hommes de loi, le détournement éventuel des textes par les utilisateurs tenaillés entre la reconnaissance du droit de l'enfant et celui de ses parents. Le but de ces recherches est de comprendre sur quels textes, sur quelles bases juridiques le droit pénal peut sanctionner les parents auteurs d'infractions. La protection d'un enfant sans défense contre ses parents ne peut laisser unanimement indifférent. Un enfant violenté, abusé par ses protecteurs naturels doit pouvoir compter sur la loi pénale pour que justice lui soit rendue, même si le travail du juge essaie d'atténuer la faute de l'auteur des sévices pour sauver la famille, institution de référence pour élever l'enfant. Or, la répression des parents auteurs d'infractions, si elle est prévue d'une manière assez complète, apparaît cependant peu cohérente. Le sujet des parents auteurs d'infractions révèle alors toute son ambiguïté. S'il est facile de prévoir des incriminations, de définir les éléments matériels et moraux d'une infraction, d'en aggraver la répression, les incriminations restent cependant très complexes (PARTIE I). la mise en œuvre de la répression est très difficile face à une réalité sur laquelle pèsent lourdement les habitudes, l'indifférence, le respect de la vie privée de la famille et surtout le mythe de l'amour parental (PARTIE II).
