Dans une approche interdisciplinaire, nous allons nous intéresser à la participation du MNA dans l'élaboration de solutions durables. Afin de définir les contours de sa capacité d'agir, nous nous attacherons ainsi à soulever d'une part les contraintes auxquelles il doit faire face et d'autre part, les ressources dont il dispose pour agir. Souhaitant donner voix aux MNA, nous nous référerons particulièrement au projet Speak out!, qui est un projet de participation sociopolitique mis en place par la Fondation Terre des hommes - aide à l'enfance pour ces jeunes migrants. En définitive, cette analyse nous permettra d'avancer des éléments de réflexion pour une intervention individualisée qui réponde aux besoins réels des MNA et contribue à la construction de leur avenir, que ce soit au sein d'une intégration en Suisse ou d'une réintégration dans leur pays d'origine.

Ensuite, nous chercherons à comprendre les ressources dont disposent ces migrants et les mesures à envisagerr pour améliorer leur situation quotidienne. Des enfants livrés à eux-mêmes qui, traversant de nombreux pays et bravant de multiples dangers, viennent chercher en Suisse un avenir meilleur. Dans notre pays, les MNA peuvent choisir de séjourner dans leur famille élargie et/ou, s'ils ne veulent pas rester dans la clandestinité, peuvent y déposer une demande d'asile. Certains d'entre eux n'ont toutefois pas l'opportunité de voir leur requête examinée au fond et se voient notifier une décision de non-entrée en matière (NEM). L'autorité leur signifie ainsi clairement qu0ils ont la possibilité de demeurer en Suisse que dans l'attente de l'exécution de leur renvoi. Suite à un rappel à l'ordre de l'Office fédéral des migrations (ODM), le nombre de MNA faisant l'objet d'une telle décision a très fortement diminué depuis trois ans. C'est ainsi qu' au cours du 1er trimestre 2006, seules 3 décisions de non-entrée en matière avait effectivement trait à des MNA ! Ces décisions de non-entrée en matière notifiée aux MNA ont deux conséquences dramatiques, dont la gestion incombe aux cantons. En premier lieu, ce statut prive les MNA d'aide social. Ceux-ci ne bénéficient plus que d'une aide d'urgence en nature correspondant à un montant sensiblement moins élevé que celui versé au titre de l'aide sociale. En deuxième lieu, les MNA peuvent être, à certaines conditions, placés en détention administrative s'ils refusent de quitter la Suisse. Or, tant le fait de ne pas entrer en matière sur une demande d'asile d'un MNA que celui de lui octroyer en nature une aide d'urgence et de le mettre en détention administrative sont incompatibles avec les principes de la Convention dur les droits de l'enfant de l'ONU ratifié par la Suisse en 1997. Ces violations de la CDE en entraînent malheureusement d'autres. Ces manquements sont d'autant plus regrettables que l'ODM aurait les moyens de se montrer moins drastiques et d'unifier les pratiques prévalant dans les cantons. Des solutions autres que celles de l'asile seraient, de même, envisageables. Ce travail se conclut ainsi sur un terrible constat : la volonté et le courage politique en la matière n'existe pas.
