Book excerpt: Les sociétés indo-océanes, coloniales et postcoloniales, plurielles, en mouvement constant, sont propices à l'observation de la diversité et à la multiplicité des figures du droit, explicites ou cachées, qui illustrent l'extrême variété de la condition humaine. Cette condition humaine, le droit la retrace certainement, mais jamais plus toutefois que sous la forme d'une ombre projetée. De surcroît, l'immensité des champs que la règle de droit est amenée, dans l'espace et le temps, à recouvrir est indiscernable. L'ouvrage met en évidence des productions juridiques indo-océanes, jugées originales et représentatives d'une pratique sociale ou culturelle. Un canevas relie celles-ci sur la base d'une double relation, la relation entre droit et cultures et la relation entre droit et pouvoir. Cette double interrelation principale prétend présenter un classement des normes juridiques, prises à travers l'exemple des normes indo-océanes et offrir une grille d'analyse, partant du simple pour comprendre le complexe, en abordant par le truchement de la règle juridique certains des thèmes significatifs de la condition humaine. Deux tensions majeures sont décrites. La première concerne l'opposition entre asservissement par le droit et libération par le droit. Sa résolution appelle une posture politique radicale qui vise à faire émerger un droit des Droits de l'homme. La seconde tension majeure est plus délicate à résoudre. Elle intéresse la pensée moderne et la pensée traditionnelle et illustre leur incapacité à entretenir un dialogue constructif, porteur d'un équilibre dynamique, fondateur d'un droit tiers et concilié. Souvent, leurs rapports aboutissent à des solutions radicales et caricaturales, évidemment conservatrices, négatrices de l'altérité. Par exception, le cas du droit pluraliste malgache de la famille montre qu'un dialogue entre les sources formelles, la loi et la coutume, est réalisable. Il est le prélude à un dialogue plus délicat à engager dans la perspective d'un droit nouveau, le droit de l'altérité et de soi. Ainsi l'océan Indien ouvre la voie à une anthropologie juridique des droits de l'homme.

These conflicts are likely to arise between emerging Asian States such as China and India whose material power is growing, and the Western nations who wield significant ideational power. A West-centric international society will change to a multi-polar and multi-civilizational global society. This structural change includes, and further needs, changes of understandings and perceptions of the world, including of international law. The perspectives from which we see, understand, appreciate and assess international law must change. We need to interpret international law not only from a prevalent Statecentric international perspective and West-centric transnational perspective. Onuma argues that we must grasp international law from what he calls a trans-civilizational perspective as well. By adopting such three-layered perspectives, international law is shown to be functioning as a tool of politics yet constrained by cultural and civilizational factors. Such complex subjects as global history of international law, concepts of general and customary international law, and human rights could be appreciated in a more nuanced and subtle manner.
