Dans une première partie, après avoir dressé le constat que la loi du 28 mars 2014 (portant insertion d'un titre 2 "De l'action en réparation collective" au livre XVII "Procédures juridictionnelles particulières" du Code de droit économique et portant insertion des définitions propres au livre XVII dans le livre 1er du Code de droit économique) comporte des faiblesses importantes, il est démontré qu'elle se concilie mal avec le droit commun de la responsabilité civile que l'action en réparation collective tend cependant à mettre en oeuvre et ce, en particulier, lorsque le tribunal saisi fera le choix du mécanisme de l'option d'exclusion pour composer le groupe. Le droit de la responsabilité civile est en effet fondé sur une approche individualiste. La victime doit établir non seulement une faute, ou plus généralement un fait générateur, mais encore un dommage personnel en relation causale avec cette faute. De plus, il n'a pas été conçu pour répondre à l'hypothèse où les personnes à indemniser sont inconnues au moment où le juge se prononce sur le fond de la demande. D'où l'invitation à s'interroger, dans une deuxième partie, sur la manière dont le droit québécois est parvenu à assurer une coordination de l'action collective avec le droit commun de la responsabilité civile. Le choix du Québec comme point de comparaison s'explique, d'une part, par l'expérience acquise depuis l'entrée en vigueur le 19 janvier 1978 de la loi sur le recours collectif et, d'autre part, par la proximité des droits québécois et belge qui s'inscrivent dans la même tradition civiliste même si le droit québécois entretient également des rapports étroits avec la common law. Sur la base de l'examen de droit comparé et après une analyse au regard du principe constitutionnel d'égalité et de non-discrimination, il est proposé, dans une troisième partie, "d'importer" en droit belge trois "outils" issus du droit québécois pour renforcer l'efficacité du système en place en Belgique.

Pour les appréhender la notion de dommages de masse est utile, en tant qu'elle désigne les atteintes portées aux personnes, aux biens ou au milieu naturel qui touchent un grand nombre de victimes à l'occasion d'un fait dommageable unique, ce dernier pouvant consister en un ensemble de faits dommageables ayant une origine commune. L'enjeu déterminant de leur réparation invite à les confronter à la responsabilité civile et à se pencher sur le rôle de cette dernière. Sous un angle nouveau, la notion de dommages de masse permet de mettre en valeur l'impact de tels dommages sur les approches classiques de la responsabilité civile construite sur un modèle individuel. La dimension collective des dommages de masse influe sur l'appréciation des dommages individuels et favorise l'apparition de nouveaux préjudices. Mais les dommages de masse participent aussi à l'expression d'une remise en cause de l'aptitude de la responsabilité civile à les surmonter. Conduisant tantôt à l'aménager ou à l'écarter, ils soulignent l'hétérogénéité de ses règles, un affaiblissement de son rôle, ses limites, et la mettent en concurrence avec des mécanismes d'indemnisation collective fondés sur la solidarité nationale. Il faut pourtant reconnaître à la responsabilité civile un rôle déterminant dans l'indemnisation des dommages de masse, ainsi que des vertus indispensables à travers notamment ses fonctions préventive et normative qui contrastent avec les défauts d'autres mécanismes d'indemnisation. La responsabilité civile mérite alors d'être défendue et aussi renforcée, par des régimes spéciaux de responsabilité susceptibles d'améliorer l'offre d'indemnisation, voire par un droit d'exception au delà d'un certain seuil de dommages, mais aussi par des outils tels qu'un modèle de règlement amiable juridiquement encadré et une action de groupe.
