Malgré son caractère controversé, la création artistique contemporaine ne semble pas avoir jusqu’ici suffisamment retenu l’attention des juristes. C’est la raison pour laquelle l’Unité de droit économique de l’Université libre de Bruxelles (U.L.B.) et l’Unité Art, Law & Management de la KU Leuven ont organisé à Bruxelles, au musée d’art contemporain Wiels, le 12 mai 2011, un colloque autour des particularités juridiques de la création artistique contemporaine. Le présent ouvrage en reproduit les Actes, sous la direction des professeurs Andrée Puttemans, Doyenne de la Faculté de droit et de criminologie de l’U.L.B., et Bert Demarsin, Vice-Doyen de la Faculté de droit de la HUB (Hogeschool — Universiteit Brussel). Julien Cabay analyse d’un regard neuf la notion d’oeuvre en droit d’auteur, sous l’éclairage des pratiques de la création artistique contemporaine. Hendrik Vanhees nous entretient ensuite du régime du droit de suite, qui permet à l’auteur d’une œuvre d’art moderne ou contemporain de percevoir une participation sur le prix des reventes de son œuvre et qui constitue ainsi un paramètre dont les acteurs du marché tiennent compte pour la détermination du lieu de vente idéal. Enfin, Bert Demarsin commente une panoplie de cas limites nés de difficultés d’application du droit fiscal au domaine de l’art, provenant de diverses juridictions, et propose une approche pragmatique du problème éternel de la définition de l’œuvre d’art (contemporain).

This paradox has shaped discussions on authorship since at least the 1960s, when the dominant notion of the individual author-genius was first critically questioned. The ongoing discussion has mainly focused on literature and the arts, but has ignored nearly any artistic practice beyond these two fields. “Constructions of Media Authorship” aims to fill this gap: the volume’s interdisciplinary contributions reflect historical and current artistic practices within various media and attempt to grasp them from different perspectives. The first part sheds a new light on different artistic and design practices and questions the still dominant view on the individual identifiable author. The second part discusses creative practices in literature, emphasizing the interrelation of aesthetic discourses and media practices. The third part investigates authoring in audiovisual media, especially film and TV, while the final part turns to electronic and digital media and their collective creativity and hybrid mediality. The volume is also an attempt to develop new methodological approaches, focusing on the interplay between various human and non-human actors in different media constellations.

Book excerpt: This book addresses one of the core challenges in the corporate social responsibility (or business and human rights) debate: how to ensure adequate access to remedy for victims of corporate abuses that infringe upon their human rights. However, ensuring access to remedy depends on a series of normative and judicial elements that become highly complex when disputes are transnational. In such cases, courts need to consider and apply different laws that relate to company governance, to determine the competent forum, to define which bodies of law to apply, and to ensure the adequate execution of judgments. The book also discusses how alternative methods of dispute settlement can relate to this topic, and the important role that private international law plays in access to remedy for corporate-related human rights abuses. This collection comprises 20 national reports from jurisdictions in Europe, North America, Latin America and Asia, addressing the private international law aspects of corporate social responsibility. They provide an overview of the legal differences between geographical areas, and offer numerous examples of how states and their courts have resolved disputes involving private international law elements. The book draws two preliminary conclusions: that there is a need for a better understanding of the role that private international law plays in cases involving transnational elements, in order to better design transnational solutions to the issues posed by economic globalisation; and that the treaty negotiations on business and human rights in the United Nations could offer a forum to clarify and unify several of the elements that underpin transnational disputes involving corporate human rights abuses, which could also help to identify and bridge the existing gaps that limit effective access to remedy. Adopting a comparative approach, this book appeals to academics, lawyers, judges and legislators concerned with the issue of access to remedy and reparation for corporate abuses under the prism of private international law.
