Book excerpt: L'encadrement des lobbyistes au Canada, au Québec, en Ontario, en France, et au sein des institutions européennes RésuméLe système fédéral canadien d'encadrement des lobbyistes, mis en place dès 1989 avec l'adoption de la loi sur l'enregistrement des lobbyistes, est souvent cité comme le modèle à atteindre par les Etats démocratiques. Cette thèse vise à comparer ce système d'encadrement, particulièrement abouti, à ceux existants au Québec, en Ontario, en France et au sein des institutions européennes. Trois grands enjeux majeurs sont ainsi analysés dans ce travail de recherche : les raisons structurelles et conjoncturelles justifiant le recours au droit pour encadrer les représentants d'intérêt/lobbyistes dans ces terrains; le fonctionnement et les acteurs chargés de cette règlementation (analyse des nomenclatures, dispositifs juridiques existants, mise en place d'une administration spécifique, etc.), ainsi que ceux auxquels elle s'applique; et enfin la variété des formes de réglementation et les effets induits par celle-ci, au regard des objectifs initiaux fixés par les législateurs et les gouvernements. Ce travail universitaire offre une analyse réflexive sur la capacité des législateurs et des gouvernants à atteindre les objectifs fixés initialement par les réglementations en matière de lobbying (limitation de la corruption, et diminution des scandales politiques), à travers l'ambition démocratique d'une transparence plus efficace et plus efficiente.
