La notion de vie privée participe grandement à ce péril puisque, si sa protection peut se ramener à celle d'une foule de données et informations, la nature de celles-ci ne détermine pas pour autant le régime juridique qui leur est applicable. Ainsi, il n'est pas si surprenant de constater qu'en jurisprudence, la modification de l'Etat civil, alors que celui-ci repose sur une bonne part d'imposition étatique, se fonde paradoxalement sur le droit au respect de la vie privée devant ces apories conceptuelles, nous constatons l'émergence de la catégorie des données et informations à caractère personnel dont le critère commun réside dans l'identification de la personne ainsi permise. À partir de cette notion fonctionnelle, il devient alors possible de penser son utilisation et d'en rendre compte. Il apparaît que l'utilisation exceptionnelle des données et informations à caractère personnel pour des finalités d'intérêt général (justice pénale, santé publique et information du public) est très extensive. Il convient dès lors de restaurer dans toute sa plénitude le principe de la protection des données et informations à caractère personnel en appréciant strictement ses dérogations et en s'appuyant notamment sur l'indispensable garde-fou que constitue l'indisponibilité.
