Book excerpt: In twelve topical papers, written by renowned experts in distinct areas of the law, the reader will find out how private law and private international law instruments can serve public policy goals (such as the protection of the environment, product safety or services of general economic interest) and how these instruments interact with regulation in the proper sense. A must for those who want to explore the borderline if it exists between public and private law in the EU. Jules Stuyck, Leuven University, Belgium In the context of the current debate on the desirability and process of forming European private law (EPL), this book considers one fundamental question addressing its descriptive and normative dimension: does and should EPL pursue regulatory objectives beyond market integration? The editors argue that because national categories are of little help in grasping the characteristics of a multi-level regulatory system, it is necessary to link three perspectives: private law, regulation and conflict of laws. This book explores this interaction in four distinct fields: product liability, environmental protection, public utilities and e-commerce. The results show that EPL is highly regulatory and that the implications of this change have not been adequately considered by institutions and by scholars. The Regulatory Function of European Private Law will be of great interest to academics of law, as well as to private and public lawyers and European policymakers.

Catherine Geslain-Lanéelle Executive Director European Food Safety Authority (EFSA) Parma, March 2008 Acknowledgements This book and the General Framework for the Precautionary and Inclusive Governance of Food Safety that it presents and critically discusses have grown out of research undertaken within one of the subprojects (work package 5) of the research project SAFE FOODS, ‘Promoting Food Safety through a New Integrated Risk Analysis Approach for Foods’. The Integrated Project SAFE FOODS has been funded by the European Commission under the 6th Framework Programme (April 2004 to June 2008) and coordinated by Dr H.A. Kuiper and Dr H.J.P. Marvin of RIKILT-Institute of Food Safety at the University of Wageningen in the Netherlands. Subproject 5 of SAFE FOODS has dealt with institutional aspects of food safety governance with a focus on ways (procedural and structural mec- nisms) to improve the implementation of precaution, participation and a politi- science interface, and has been coordinated by the editors of this book. The General Framework and this book have been a collaborative effort of subproject 5 in which all contributors to the first part of this book were involved. We have very much appreciated this exceptionally fruitful cooperation. It has always been both greatly intellectually inspiring (with many intensive, focused discussions) and very pleasant (highly cooperative and reliable).

It is consumer choice of producers and products on the basis of attitudes and values of personal and family well-being as well as ethical or political assessment of business and government practice. In the face of economic globalization and a regulatory vacuum, consumers increasingly take responsibility in their own hands, making the market an important venue for political action through their decisions of what to purchase. This book opens the readers' eyes to a new way of viewing everyday consumer choices and the role of the market in our lives, illuminating the broader theoretical and historical context of concerns about sweatshops, responsible coffee, and ethical and free trade. Contemporary forms of political consumerism - boycotts, labelling schemes, stewardship certification, socially responsible investing, etc. - are described and evaluated. Individual actions are shown to be important in the complexity of globalization.

Available in PDF, EPUB and Kindle. Book excerpt: Criminal law can no longer be neatly categorised as the product and responsibility of domestic law. That this is true is emphasised by the ever-increasing amount of legislation stemming from the European Union (EU) which impacts, both directly and indirectly, on the criminal law. The involvement of the EU institutions in the substantive criminal laws of its Member States is of considerable legal and political significance. This book deals with the emerging EU framework for creating, harmonising and ensuring the application of EU criminal law. This book aims to highlight some of the consequences of EU involvement in the criminal law by examining the provisions which have been adopted in the field of information and communications technology. It provides an overview of the criminal law competence of the EU and evaluates the impact of these developments on the criminal laws of the Member States. It then goes on to consider the EU legislation which requires Member States to regulate matters such as data protection, e-security, intellectual property and various types of illegal content through the criminal law is analysed. In the course of this evaluation, particular consideration is given to issues such as the basis on which the EU institutions establish the need for criminal sanctions, the liability of service providers and the extent to which the Member States have adhered to, or departed from, the legislation in the course of implementation.

Available in PDF, EPUB and Kindle. Book excerpt: The Association Henri Capitant des Amis de la Culture Juridique Française and the Société de législation comparée joined the academic network on European Contract Law in 2005 to work on the elaboration of a "common terminology" and on "guiding principles" as well as to propose a revised version of the Principles of European Contract Law (PECL). The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law.
