Unter der zentralen Fragestellung, welche Auswirkungen der durch den Verfassungsvertrag eingeführte Machtzuwachs des Europäischen Parlaments auf das europäische Institutionengefüge und auf die europäische Handlungsebene haben wird, soll die Hausarbeit eine theoretische Prognose leisten, inwieweit es sich dabei um eine Steigerung der Legitimität und Handlungsfähigkeit handelt. Die Hausarbeit testet die These, dass der Machtzuwachs des Europäischen Parlaments zu einem Zuwachs an Legitimität und Handlungsfähigkeit der europäischen Politik führt. Vor dem Hintergrund der oft kritisierten Defizite an Legitimität, Demokratie, Effizienz und Transparenz, die die Union aufweist und die sich in demographischen Umfragen wie dem Eurobarometer empirisch belegen lassen, fand eine lange Reformdiskussion sowohl in der Fachliteratur als auch auf den Regierungskonferenzen statt. Seit der Unterzeichnung des Verfassungsvertrags durch die Staats- und Regierungschefs am 29. Oktober 2004 in Rom ist es möglich, diese Diskussion nicht nur in Form von mitunter weit auseinandergehenden Vorstellungen und Vorschlägen zur Verbesserung der genannten Defizite zu führen, sondern auf Grundlage eines vom Konvent erarbeiteten, von den nationalen Regierungen angenommenen und inzwischen in vier Mitgliedstaaten ratifizierten Lösungsvorschlages. Die Hausarbeit wird auf der Grundlage der Texte des Konvents und der Regierungskonferenz sowie der das Thema betreffenden Fachliteratur die Behauptung des Konvents überprüfen, der Verfassungsvertrag löse die Legitimations- und Demokratiedefizite. Begleitend stellen sich daneben auch die Fragen, ob der Verfassungsvertrag die Europäische Union neu charakterisiert und warum eine Regierungskonferenz Interesse an einer Parlamentarisierung der Europäischen Union hat. Sowohl durch die Fachliteratur als auch durch die Machterweiterung des Parlaments durch den Verfassungsvertrag wird der Fokus auf den Kernpunkt der demokratischen Legitimation in der Frage nach dem Verhältnis von Regierenden und Regierten auf das Europäische Parlament gerichtet.
