The introduction of co-legislation between the Council of Ministers and the European Parliament in 1993 raised the prospect of increased parliamentary involvement in EU decision-making and promised a new era of more transparent, inclusive and accountable policy-making. Once a proposal was submitted by the European Commission, Council and Parliament will decide on the issue by using one of four forms of legislative procedures: codecision, consultation or assent and cooperation. The choice of procedure depends on the policy area of the proposal. Influence and power of Parliament and Council differ depending on the type of legislative procedure in use. There are cases in which the Council is dominant, for example in the decision on the directive on software patents , and areas in which the Parliament is dominant, such as the decision on stock storage of telecommunication data in 2005.

Applying a 'constitutional lens' to this 'regulatory' topic, Anne Meuwese examines both the details and the framework of IA in EU lawmaking to date, drawing attention to its strengths, its contradictions, and its power to enhance the deliberative quality of legislative debates. Integrating the perspectives of political scientists and economists with the concerns of legal scholars and practitioners, Dr Meuwese describes and interrelates such aspects of the subject as the following: the potential role of impact assessment as a catalyst of legal principles, by emphasising or overriding norms that govern both the procedural and the substantive aspects of the EU legislative process; the 'constitutional tasks' of impact assessment as applied to European legislative proposals, especially relating to subsidiarity, proportionality, and the precautionary principle; the formal and informal extension of the scope of impact assessment beyond the co-decision procedure; the question whether impact assessment crosses the line between informing the legislator and fettering legislative discretion. Book excerpt: The recent empowerment of the European Parliament makes this a timely study of the impact of its internal organisation on legislative politics, interest representation and democracy within the Union. Using data on all legislators and legislative proposals in the 6th parliamentary term, the book confronts alternative theories of legislative organisation in rigorous statistical analyses supported by rich interview information. The findings indicate that the internal setup and legislative output of the parliamentary committees serve the policy goals of parties in the European Parliament, and in particular the working majority party, rather than special interests or purely informational needs, which the author explains with the formal and informal parliamentary rules. As the committees advance party politics instead of particularistic policies, she concludes that legislating within the committees is positive for democracy in the European Union and raises concerns about the loss in transparency, legitimacy and accountability that the increasingly common fast-track bicameral decision-making outside the committees entails.
